§ 105d AufenthG: Übergangsregelung für das Verfahren zur Prüfung einer missbräuchlichen Anerkennung der Vaterschaft

Transitional Rule for Checks on an Acknowledgement of Paternity (§ 105d AufenthG)
In certain cases the authorities check whether an acknowledgement of paternity (Anerkennung der Vaterschaft) is abusive. There is a transitional rule for checks that are still running.
Which law applies to ongoing checks? (para. 1)
If a check is not completed by the end of 28.07.2026, the old law applies to it. The following provisions then apply in the version in force on 28.07.2026:
- § 60a para. 2 sentence 4 of the Residence Act,
- § 84 para. 1 no. 8 of the Residence Act,
- § 85a of the Residence Act,
- § 1597a and § 1598 of the Civil Code (Bürgerliches Gesetzbuch).
Exception for another child (para. 2)
§ 85a para. 2 no. 2b does not apply if two points come together:
- Legal paternity for the other child arose through an acknowledgement of paternity.
- The declaration of acknowledgement was publicly notarised before 29.07.2026.
This exception does not apply if the foreigners authority (Ausländerbehörde) has discontinued the procedure for the other child. This means a procedure under § 85a para. 1 sentence 3 in the version in force until 29.07.2026.
(1) Auf Prüfungen über das Vorliegen einer missbräuchlichen Anerkennung der Vaterschaft, die bis zum Ablauf des 28. Juli 2026 nicht abgeschlossen sind, sind § 60a Absatz 2 Satz 4, § 84 Absatz 1 Nummer 8 und § 85a dieses Gesetzes sowie die §§ 1597a und 1598 des Bürgerlichen Gesetzbuchs in der am 28. Juli 2026 jeweils geltenden Fassung anzuwenden.
(2) § 85a Absatz 2 Nummer 2b gilt nicht, wenn die rechtliche Vaterschaft für das andere Kind durch Anerkennung der Vaterschaft entstanden ist und die Anerkennungserklärung vor dem 29. Juli 2026 öffentlich beurkundet wurde. Satz 1 gilt nicht, wenn die Ausländerbehörde das Verfahren nach § 85a Absatz 1 Satz 3 in der bis zum 29. Juli 2026 geltenden Fassung für das andere Kind eingestellt hat.
