§ 85c AufenthG: Verfahren zur Prüfung der Zustimmung

Procedure for examining the consent (§ 85c AufenthG)
Do you want to acknowledge a paternity, or give your consent to it as the mother? In certain cases the immigration authority (Ausländerbehörde) has to consent. This section sets out how that procedure works.
Application and decision (paragraph 1)
The immigration authority decides on the consent to an acknowledgment of paternity by written or electronic administrative act (Verwaltungsakt). An application by the acknowledging person and the mother is required. If the acknowledging person, the mother or the child dies before the decision, the procedure is not interrupted. It is continued.
Application after a death (paragraph 2)
- If the acknowledging person or the mother dies before the application was made, the application can also be made by the acknowledging person alone or by the mother alone.
- If the acknowledging person and the mother die, the child can make the application too.
Four-month deadline (paragraph 3)
If the immigration authority has not decided within four months of receiving the application, the consent counts as granted. But the deadline is suspended (gehemmt):
- if the applicants ask for the procedure to rest (Ruhen des Verfahrens) and the immigration authority agrees,
- if a deadline under paragraph 5 sentence 1 together with § 85b para. 2 expires without result because facts, actions or evidence are missing,
- if a party does not appear at a hearing they were summoned to.
The suspension ends as soon as the procedure is resumed or the missing action has been carried out.
Which authority decides (paragraph 4)
The competent authority is the immigration authority that is locally responsible for the other person under § 85a para. 1 sentence 1. State law can provide otherwise.
- If that other person habitually lives abroad, the immigration authority at the habitual residence of the party living in Germany decides.
- If none of the parties habitually lives in Germany when the application is made, the German mission abroad that is responsible for the other person decides.
Your duty to cooperate (paragraphs 5 and 6)
As an applicant you must report all facts and take all actions that are essential for the decision. You must submit the evidence you are able to provide. This applies in particular to facts and evidence under § 85b para. 2 and para. 3 sentence 2. Otherwise § 82 applies accordingly. These duties also apply if the acknowledging person or the mother holds German citizenship or an unlimited right of residence. The immigration authority must inform you about these duties. It must also tell you the possible consequences if you do not fulfil them. What matters here is the presumption rule in § 85b para. 2 no. 5.
(1) Die Ausländerbehörde entscheidet über die Erteilung der Zustimmung zur Anerkennung einer Vaterschaft durch schriftlichen oder elektronischen Verwaltungsakt auf Antrag des Anerkennenden und der Mutter. Verstirbt der Anerkennende, die Mutter oder das Kind vor einer Entscheidung der Ausländerbehörde, so wird das Verfahren nicht unterbrochen und ist fortzusetzen.
(2) Verstirbt der Anerkennende oder die Mutter, bevor der Antrag auf Zustimmung zur Anerkennung der Vaterschaft gestellt worden ist, kann der Antrag auf Zustimmung abweichend von Absatz 1 Satz 1 auch nur von dem Anerkennenden oder der Mutter gestellt werden. Versterben der Anerkennende und die Mutter, kann der Antrag auf Zustimmung abweichend von Absatz 1 Satz 1 auch von dem Kind gestellt werden.
(3) Die Zustimmung zur Anerkennung einer Vaterschaft gilt als erteilt, wenn die Ausländerbehörde nicht binnen vier Monaten nach Eingang des Antrags entschieden hat. Der Ablauf der Frist nach Satz 1 wird gehemmt, wenn die Antragsteller einen Antrag auf Ruhen des Verfahrens stellen und die Ausländerbehörde diesem zustimmt. Der Ablauf der Frist nach Satz 1 wird auch gehemmt, wenn eine den Beteiligten zur Mitteilung von Tatsachen und Vornahme von Handlungen oder Beibringung von Nachweisen nach Absatz 5 Satz 1 in Verbindung mit § 85b Absatz 2 gesetzte Frist fruchtlos abläuft oder ein Beteiligter zu einer Anhörung, zu der er geladen wurde, nicht erscheint. Die Hemmung nach den Sätzen 2 und 3 endet, sobald das Verfahren wieder aufgenommen wird oder die unterlassene Handlung durch den oder die Beteiligten vorgenommen wurde.
(4) Vorbehaltlich abweichender Bestimmungen durch Landesrecht entscheidet die Ausländerbehörde über den Antrag, die für die jeweils andere Person im Sinne des § 85a Absatz 1 Satz 1 örtlich zuständig ist. Hat die jeweils andere Person ihren gewöhnlichen Aufenthalt im Ausland, so entscheidet vorbehaltlich abweichender Bestimmungen durch Landesrecht die Ausländerbehörde über den Antrag, in deren Zuständigkeitsbezirk der im Inland lebende Beteiligte seinen gewöhnlichen Aufenthalt hat. Hat keiner der Beteiligten zum Zeitpunkt des Antrags auf Zustimmung seinen gewöhnlichen Aufenthalt im Inland, ist die deutsche Auslandsvertretung für die Entscheidung über den Antrag örtlich zuständig, die für die jeweils andere Person im Sinne des § 85a Absatz 1 Satz 1 örtlich zuständig ist.
(5) Die Antragsteller sind verpflichtet, diejenigen Tatsachen mitzuteilen und Handlungen vorzunehmen, die für die Entscheidung der Ausländerbehörde über den Antrag auf Zustimmung wesentlich sind, sowie hierfür erforderliche Nachweise, die sie erbringen können, vorzulegen; dies gilt insbesondere für Tatsachen und Nachweise im Sinne des § 85b Absatz 2 und 3 Satz 2. Im Übrigen gilt § 82 entsprechend. Die Sätze 1 und 2 gelten entsprechend, wenn der Anerkennende oder die Mutter die deutsche Staatsangehörigkeit oder ein unbefristetes Aufenthaltsrecht besitzen.
(6) Die Antragsteller sind auf ihre Pflichten nach Absatz 5 und auf mögliche Folgen einer Nichterfüllung, insbesondere auf die Vermutungsregelung in § 85b Absatz 2 Nummer 5, hinzuweisen.
