§ 85d AufenthG: Anzeige einer fehlenden Zustimmung gegenüber dem Standesamt; Rücknahme der Zustimmung oder der Feststellung, dass eine solche nicht erforderlich ist

Missing consent and withdrawal of consent (§ 85d AufenthG)
This section covers two questions: what happens if a paternity was entered without the required consent? And when can the immigration authority (Ausländerbehörde) withdraw a consent it has already granted?
Notification to the registry office (paragraph 1)
If the immigration authority learns that a paternity was entered into a German civil status register (Personenstandsregister) without the required consent, it notifies the registry office (Standesamt). The competent registry office is the one responsible for the child's birth.
When the consent can be withdrawn (paragraph 2)
The immigration authority can only withdraw the consent if the consent was obtained through:
- fraudulent deception (arglistige Täuschung),
- threat or bribery,
- intentionally incorrect or incomplete statements that were essential for granting it.
If the immigration authority withdraws the consent, it notifies the registry office responsible for the child's birth.
Time limits for the withdrawal (paragraph 3)
- Rule: the withdrawal is permitted at most five years after the paternity was entered into a German civil status register.
- If the child had already completed its fifth year of life at the time of the entry and acquired German citizenship from the acknowledging father under § 4 para. 1 or para. 3 of the Nationality Act (Staatsangehörigkeitsgesetz), the withdrawal is permitted at most two years after the entry.
- If the child only completes its fifth year of life within the five-year period and has acquired German citizenship from the acknowledging father, the withdrawal is permitted at most two years from the fifth birthday — and only within five years after the entry.
If the child's birth was not registered in Germany, the consent of the immigration authority to the acknowledgment of paternity takes the place of the entry. § 17 para. 2 sentence 3 no. 2 to 4 of the Nationality Act applies accordingly.
Effect and determinations (paragraphs 4 and 5)
The withdrawal of the consent takes effect for the past, that is retroactively. Paragraphs 2 to 4 apply accordingly to determinations by the immigration authority under § 85a para. 3 — the determination that no consent is required.
(1) Erlangt die Ausländerbehörde davon Kenntnis, dass ohne die erforderliche Zustimmung der Ausländerbehörde eine Eintragung der Vaterschaft in ein deutsches Personenstandsregister erfolgt ist, zeigt sie dies dem für die Geburt des Kindes zuständigen Standesamt an.
(2) Die Ausländerbehörde kann die Zustimmung nur zurücknehmen, wenn sie durch arglistige Täuschung, durch Drohung oder Bestechung oder durch vorsätzlich unrichtige oder unvollständige Angaben, die wesentlich für ihre Erteilung gewesen sind, erwirkt worden ist. Nimmt die Ausländerbehörde die Zustimmung zurück, zeigt sie dies dem für die Geburt des Kindes zuständigen Standesamt an.
(3) Die Rücknahme der Zustimmung ist höchstens fünf Jahre nach Eintragung der Vaterschaft in ein deutsches Personenstandsregister zulässig. Bei Kindern, die bei Eintragung in das deutsche Personenstandsregister das fünfte Lebensjahr vollendet und die deutsche Staatsangehörigkeit vom anerkennenden Vater nach § 4 Absatz 1 oder Absatz 3 des Staatsangehörigkeitsgesetzes erworben haben, ist eine Rücknahme höchstens zwei Jahre nach Eintragung in das deutsche Personenstandsregister zulässig. Hat das Kind während der Frist nach Satz 1 das fünfte Lebensjahr vollendet und die deutsche Staatsangehörigkeit vom anerkennenden Vater nach § 4 Absatz 1 oder Absatz 3 des Staatsangehörigkeitsgesetzes erworben, ist eine Rücknahme höchstens innerhalb von zwei Jahren seit Vollendung des fünften Lebensjahres und nur innerhalb von fünf Jahren nach Eintragung in das deutsche Personenstandsregister zulässig. Ist die Geburt des Kindes nicht im Inland beurkundet, tritt in den Sätzen 1 bis 3 an die Stelle der Eintragung der Vaterschaft in ein deutsches Personenstandregister die Zustimmung der Ausländerbehörde zur Anerkennung der Vaterschaft. § 17 Absatz 2 Satz 3 Nummer 2 bis 4 des Staatsangehörigkeitsgesetzes gilt entsprechend.
(4) Die Rücknahme der Zustimmung erfolgt mit Wirkung für die Vergangenheit.
(5) Die Absätze 2 bis 4 gelten für Feststellungen der Ausländerbehörde nach § 85a Absatz 3 entsprechend.
