Your Right to Information About Your Data Is Limited (§ 91k AufenthG)
You have a right to information about your personal data. This right follows from Article 43(1) and (2) subparagraph 1 of Regulation (EU) 2024/1358 together with Article 15 of Regulation (EU) 2016/679.
Which authorities does the right apply to?
The right applies to the authorities designated under Regulation (EU) 2024/1358. These authorities process data for the purposes of Article 1(1)(a), (b), (c) and (j) of Regulation (EU) 2024/1358.
What is excluded from the information?
The right to information does not cover every entry. Entries stating that a person could be a danger to internal security are excluded. You will not receive information about such entries.
Das Recht der betroffenen Person auf Auskunft über die sie betreffenden personenbezogenen Daten nach Artikel 43 Absatz 1 und 2 Unterabsatz 1 der Verordnung (EU) 2024/1358 in Verbindung mit Artikel 15 der Verordnung (EU) 2016/679 gegenüber den nach der Verordnung (EU) 2024/1358 benannten Behörden, die Daten zum Zwecke des Artikels 1 Absatz 1 Buchstabe a, b, c und j der Verordnung (EU) 2024/1358 verarbeiten, erstreckt sich nicht auf Einträge darüber, dass die Person eine Gefahr für die innere Sicherheit darstellen könnte.
