How do you extend your toleration status (Duldung)?
You are required to leave Germany, but your deportation is not possible for factual or legal reasons? Then your deportation is suspended. This is called Duldung (toleration status). You will receive a temporary certificate for this.
This certificate is extended until deportation becomes possible or you can be granted a residence permit. An extension is possible at the earliest 4 weeks before the certificate expires.
Note: You have been living in Germany continuously for at least five years as of 31.10.2022? Then, under certain conditions, you may be granted a Chancen-Aufenthaltserlaubnis (opportunity residence permit) for 18 months. Use the online application for this (see section Further information).
Requirements
Who qualifies?
- The reasons for the suspension of your deportation still apply. Your deportation is still not possible for factual or legal reasons.
Additional requirements
- You must have your primary residence in Berlin. There must be no obligation to reside in another federal state.
- From the age of 18 you must appear in person with an appointment. Make an appointment via the contact form with the responsible department A 2, A 3, or A 4. Minors under 18 do not need to appear in person. For children of compulsory school age, you are asked to present a current school certificate.
How to apply
Check whether your certificate of the toleration status (Duldung) expires in less than 4 weeks
Make an appointment via the contact form with the responsible department A 2, A 3, or A 4 of the State Office for Immigration
Bring a current biometric photo, your previous Duldung certificate, and all other required documents
Appear in person at the State Office for Immigration
Done! You will receive an extended certificate of your toleration status (Duldung)

- Upon presentation of current proof of receiving benefits under the Asylum Seekers Benefits Act
Good to know
If you cannot be deported, your toleration status (Duldung) is normally extended by 24 months. The authority follows Section 25 paragraph 5 sentence 2 as guidance. There is no statutory maximum duration for the Duldung.
Orientiert an der Frist des § 25 Abs. 5 Satz 2 wird die Duldung grundsätzlich für 24 Monate verlängert, so nicht ohnehin eine Aufenthaltserlaubnis etwa nach § 25 Abs. 5 erteilt werden kann.

If you are needed as a witness for criminal proceedings, you will receive toleration status (Duldung). The Duldung is valid for at least 6 months. It is extended by the same period until the end of the criminal proceedings.
Bei der erstmaligen Erteilung der Duldung gem. § 60a Abs. 2 S. 2 oder S. 3 beträgt die Gültigkeit mindestens sechs Monate. Bis zum Abschluss des Strafverfahrens sollte die Duldung jeweils um den gleichen Zeitraum verlängert werden.
