§ 18d AufenthG: Research

Section 18d Residence Act: Residence Permit for Research
Who does this apply to? You want to do research in Germany. You have a hosting agreement or a corresponding contract with a research institution.
Your legal entitlement
You have a legal entitlement to a residence permit for research if you meet one of the following two conditions.
Condition A: You have a valid hosting agreement or a corresponding contract with a research institution. This research institution is officially recognized for the special admission procedure for researchers in Germany.
Condition B: You have a valid hosting agreement or a corresponding contract with a research institution. This research institution carries out research without being specially recognized.
In addition, the following must apply: The research institution must commit in writing to bearing certain costs. This applies for the period up to six months after your hosting agreement ends. The research institution then bears:
- your living costs, if you are staying unlawfully in a member state of the European Union, and
- the costs of your deportation.
If you meet condition A, a fixed deadline also applies: the authority must grant you the residence permit within 60 days of your application. This is mandatory — it is not at the authority's discretion.
You do not need the approval of the Federal Employment Agency (Bundesagentur für Arbeit) for this. This is different for some other residence permits.
When the cost undertaking is not needed
The authority should generally waive the cost undertaking if the research institution's work is predominantly financed from public funds. This means: in this case, you normally get your residence permit without this cost undertaking. Only in special exceptional cases does the authority still require it.
The authority may also waive the cost undertaking if there is a special public interest in your research project. This is a discretionary decision: the authority decides on a case-by-case basis whether to waive it.
Additional supplementary rules from Section 66(5), Section 67(3), and Section 68(2) sentences 3 and 4 and (4) of the Residence Act also apply to the cost undertaking itself.
General declaration by the research institution
The research institution can also submit the cost undertaking once, to the body responsible for its recognition. This general declaration then applies to all foreign nationals who receive a residence permit based on a hosting agreement with this research institution.
How long is your residence permit valid?
The authority must grant you the residence permit for at least one year.
Are you taking part in a European Union programme or a multilateral programme involving mobility measures? Then the authority must grant you the residence permit for at least two years.
Does your research project last for a shorter period than these minimum periods? Then, by way of exception, you get the residence permit limited only to the duration of your research project. If you are taking part in a mobility programme at the same time, the period is still at least one year.
What can you do with this residence permit?
You may work at the research institution named in your hosting agreement. You may also work in teaching.
Does your research project change during your stay? That is not a problem. You keep this right regardless.
Special case: You are already recognized as a beneficiary of protection in another EU member state
Are you internationally recognized as a beneficiary of protection in another member state of the European Union? Then the authority can grant you a residence permit for research in Germany. This is a discretionary decision, not a fixed legal entitlement.
To do this, you must meet two requirements:
- You meet all the conditions from the "Your legal entitlement" section above.
- You have stayed in this member state for at least two years since you were recognized as a beneficiary of protection.
In this case too, you may work at the named research institution and work in teaching, as described above.
