§ 37 AufenthG: Right to Return

Were you lawfully in Germany as a child and did you then leave the country? Then, under certain conditions, you can have a right to return.
Legal entitlement to a residence permit
If all three of the following conditions are met, the authority must grant you a residence permit. This is a legal entitlement — it is not at the authority's discretion.
- Before you left, you had lawfully lived in Germany for eight years and attended school in Germany for six years.
- Your living costs are covered. Either through your own work, or because another person has committed to providing for you for five years.
- You submit the application for the residence permit after your 15th birthday and before your 21st birthday. You must also submit the application within five years of your departure.
All three conditions must be met together.
Exception for cases of particular hardship
Would strict application of conditions 1 and 3 mean a particular hardship for you? Then the authority may (can) depart from these two conditions. This is a discretionary decision: the authority can do this, but does not have to.
The authority may also disregard condition 1 if you obtained a recognised school-leaving qualification in Germany.
Exception for forced marriage
Were you forced into marriage through violence or the threat of serious harm, and were you thereby prevented from returning to Germany?
Then the authority may (can) depart from conditions 1, 2 and 3. This, too, is a discretionary decision. The requirement for this:
- You submit the application for the residence permit within three months of the coercion ending. At the latest, however, you must submit it within five years of your departure.
- It must appear guaranteed that, based on your education and living circumstances so far, you can fit into the living circumstances in Germany.
Do you meet condition 1 (eight years of lawful residence and six years of school in Germany)? And were you additionally forced into marriage through violence or threats and prevented from returning? Then the authority should generally grant you a residence permit. "Should generally" means: as a rule you will receive it, only in special exceptional cases will you not. Here too, you must submit the application within three months of the coercion ending — at the latest, however, within ten years of your departure.
The hardship exception described above continues to apply in addition.
When the authority can refuse the residence permit
The authority can refuse the residence permit. This is a discretionary decision. It may do so in these cases:
- You had been expelled, or you could have been expelled, when you left Germany.
- There is an interest in expulsion. This means: there are reasons that speak in favour of expulsion.
- You are still a minor, and no one is reliably taking care of you in Germany.
Extending the residence permit
Do you want to have your residence permit extended? Then it is not an obstacle if your living costs are no longer covered by your own work. It is also not an obstacle if the obligation to provide for you has ended after the five years have passed.
Return while receiving a pension
Do you receive a pension from a provider in Germany? And had you lawfully lived in Germany for at least eight years before you left? Then you will, as a rule, receive a residence permit. "As a rule" means: normally yes, only in special exceptional cases not.
(1) Einem Ausländer, der als Minderjähriger rechtmäßig seinen gewöhnlichen Aufenthalt im Bundesgebiet hatte, ist eine Aufenthaltserlaubnis zu erteilen, wenn
- 1.der Ausländer sich vor seiner Ausreise acht Jahre rechtmäßig im Bundesgebiet aufgehalten und sechs Jahre im Bundesgebiet eine Schule besucht hat,
- 2.sein Lebensunterhalt aus eigener Erwerbstätigkeit oder durch eine Unterhaltsverpflichtung gesichert ist, die ein Dritter für die Dauer von fünf Jahren übernommen hat, und
- 3.der Antrag auf Erteilung der Aufenthaltserlaubnis nach Vollendung des 15. und vor Vollendung des 21. Lebensjahres sowie vor Ablauf von fünf Jahren seit der Ausreise gestellt wird.
(2) Zur Vermeidung einer besonderen Härte kann von den in Absatz 1 Satz 1 Nr. 1 und 3 bezeichneten Voraussetzungen abgewichen werden. Von den in Absatz 1 Satz 1 Nr. 1 bezeichneten Voraussetzungen kann abgesehen werden, wenn der Ausländer im Bundesgebiet einen anerkannten Schulabschluss erworben hat.
(2a) Von den in Absatz 1 Satz 1 Nummer 1 bis 3 bezeichneten Voraussetzungen kann abgewichen werden, wenn der Ausländer rechtswidrig mit Gewalt oder Drohung mit einem empfindlichen Übel zur Eingehung der Ehe genötigt und von der Rückkehr nach Deutschland abgehalten wurde, er den Antrag auf Erteilung einer Aufenthaltserlaubnis innerhalb von drei Monaten nach Wegfall der Zwangslage, spätestens jedoch vor Ablauf von fünf Jahren seit der Ausreise, stellt, und gewährleistet erscheint, dass er sich aufgrund seiner bisherigen Ausbildung und Lebensverhältnisse in die Lebensverhältnisse der Bundesrepublik Deutschland einfügen kann. Erfüllt der Ausländer die Voraussetzungen des Absatzes 1 Satz 1 Nummer 1, soll ihm eine Aufenthaltserlaubnis erteilt werden, wenn er rechtswidrig mit Gewalt oder Drohung mit einem empfindlichen Übel zur Eingehung der Ehe genötigt und von der Rückkehr nach Deutschland abgehalten wurde und er den Antrag auf Erteilung einer Aufenthaltserlaubnis innerhalb von drei Monaten nach Wegfall der Zwangslage, spätestens jedoch vor Ablauf von zehn Jahren seit der Ausreise, stellt. Absatz 2 bleibt unberührt.
(3) Die Erteilung der Aufenthaltserlaubnis kann versagt werden,
- 1.wenn der Ausländer ausgewiesen worden war oder ausgewiesen werden konnte, als er das Bundesgebiet verließ,
- 2.wenn ein Ausweisungsinteresse besteht oder
- 3.solange der Ausländer minderjährig und seine persönliche Betreuung im Bundesgebiet nicht gewährleistet ist.
(4) Der Verlängerung der Aufenthaltserlaubnis steht nicht entgegen, dass der Lebensunterhalt nicht mehr aus eigener Erwerbstätigkeit gesichert oder die Unterhaltsverpflichtung wegen Ablaufs der fünf Jahre entfallen ist.♦
(5) Einem Ausländer, der von einem Träger im Bundesgebiet Rente bezieht, wird in der Regel eine Aufenthaltserlaubnis erteilt, wenn er sich vor seiner Ausreise mindestens acht Jahre rechtmäßig im Bundesgebiet aufgehalten hat.
