§ 18 AufenthV: Exemption for holders of travel documents for refugees and stateless persons

Holders of travel documents for refugees or stateless persons do not need a residence title for a short stay in Germany. However, all of the following conditions must be met:
- The travel document was issued by an EU state, EEA state, Switzerland, or a state that is exempt from the visa requirement.
- The travel document contains a right of return. This right of return must still be valid for at least 4 months at the time of entry.
- You must not engage in any employment. Exception: Certain short-term activities under § 17 are permitted.
For refugees holding travel documents from certain states, the rule regarding the right of return does not apply.
Inhaber von Reiseausweisen für Flüchtlinge oder für Staatenlose sind für die Einreise und den Kurzaufenthalt vom Erfordernis eines Aufenthaltstitels befreit, sofern
- 1.der Reiseausweis von einem Mitgliedstaat der Europäischen Union, einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum, der Schweiz oder von einem in Anhang II der Verordnung (EU) 2018/1806 aufgeführten Staat ausgestellt wurde,
- 2.der Reiseausweis eine Rückkehrberechtigung enthält, die bei der Einreise noch mindestens vier Monate gültig ist und
- 3.sie keine Erwerbstätigkeit mit Ausnahme der in § 17 Abs. 2 bezeichneten ausüben. Satz 1 Nr. 2 gilt nicht für Inhaber von Reiseausweisen für Flüchtlinge, die von einem der in Anlage A Nr. 3 genannten Staaten ausgestellt wurden.
