§ 2 Fulfilment of the passport obligation by entry in the passport of a legal representative

Children under 16 years old do not always need their own passport. They can also fulfil the passport requirement (the obligation to hold a passport) if they are entered in the passport of a legal guardian (for example, a parent). The guardian's passport must be recognised and valid.
A special rule applies to children aged 10 and above: they must have their own photograph in the guardian's passport. Without their own photo, the entry alone is not sufficient.
Minderjährige Ausländer, die das 16. Lebensjahr noch nicht vollendet haben, erfüllen die Passpflicht auch durch Eintragung in einem anerkannten und gültigen Pass oder Passersatz eines gesetzlichen Vertreters. Für einen minderjährigen Ausländer, der das zehnte Lebensjahr vollendet hat, gilt dies nur, wenn im Pass oder Passersatz sein eigenes Lichtbild angebracht ist.
