Authorisation to Issue Regulations
The Federal Ministry of the Interior may, by statutory instrument with the consent of the Bundesrat (Federal Council), set out details for the issuance of:
- residence cards under Section 5
- permanent residence cards under Section 5(5)
- residence documents-GB under Section 16(2)
- residence documents for cross-border commuters-GB under Section 16(3)
The regulation may also set out details on the verification procedure and on electronic identity verification.
Das Bundesministerium des Innern, für Bau und Heimat wird ermächtigt, durch Rechtsverordnung mit Zustimmung des Bundesrates die Einzelheiten der Ausstellung von Aufenthaltskarten nach § 5 Absatz 1 Satz 1 und Absatz 7 Satz 1, Daueraufenthaltskarten nach § 5 Absatz 5 Satz 2, Aufenthaltsdokumenten-GB nach § 16 Absatz 2 Satz 1 und Aufenthaltsdokumenten für Grenzgänger-GB nach § 16 Absatz 3 entsprechend § 99 Absatz 1 Nummer 13a Satz 1 des Aufenthaltsgesetzes sowie Einzelheiten des Prüfverfahrens entsprechend § 34 Nummer 4 des Personalausweisgesetzes und Einzelheiten zum elektronischen Identitätsnachweis entsprechend § 34 Nummer 5 bis 7 des Personalausweisgesetzes festzulegen.
