Capacity to Act in Proceedings
You have capacity to act in proceedings under this law once you have reached the age of 16. This means: You can file applications and carry out procedural acts yourself.
You do not have capacity to act in proceedings if:
- you are legally incapable under the Civil Code, or
- a custodian has been appointed for you and a consent reservation has been ordered
Fähig zur Vornahme von Verfahrenshandlungen nach diesem Gesetz ist, wer das 16. Lebensjahr vollendet hat, sofern er nicht nach Maßgabe des Bürgerlichen Gesetzbuches geschäftsunfähig ist oder für ihn in dieser Angelegenheit ein Betreuer bestellt und ein Einwilligungsvorbehalt nach § 1825 des Bürgerlichen Gesetzbuches angeordnet ist. § 80 Absatz 3 und § 82 des Aufenthaltsgesetzes gelten entsprechend.
