Sending files to courts is not punishable

Sending immigration files to administrative courts is not punishable. The immigration authority is obligated to do so under Section 99 paragraph 1 sentence 1 of the Administrative Court Code. This applies despite the general confidentiality obligations.

Immigration authority provides information to BAMF from the file

The immigration authority can provide information from the immigration file to the BAMF. This happens upon request within the framework of the ICT Directive. It concerns decisions about mobility within the EU.

You pay the fee directly through the electronic payment system. Only then can you submit the application. You will receive your invoice after payment.

After your application is received by the State Office for Immigration, the electronic file will be sent digitally to your special electronic lawyer mailbox (beA).

Note: You can only request the complete file. Requesting individual parts is not possible.

Income documentation and financial data of the sponsor are permanently inaccessible. Your client and you as a lawyer may not view these documents in the immigration file. Social welfare authorities are also not allowed to receive this data.
