Extend Residence Permit for Turkish Workers and Family Members (ARB 1/80)

How do you extend your residence permit as a Turkish employee or family member?
You are a Turkish national and hold a residence permit under Section 4(2) of the Residence Act (AufenthG)? Then you can have it extended. The legal basis is Decision No. 1/80 of the EEC-Turkey Association Council (ARB 1/80).
The extension may apply in three cases. First: You hold a residence permit for family reunification and your spouse or a parent has worked for three years without interruption after arrival. Or a parent has worked for a total of three years and you have completed a vocational training in Germany.
Second: You have been working for the same employer for three years. Third: You have been working in the same profession for four years.
The legal basis (Section 4(2) or old version Section 4(5) AufenthG) is printed on your residence permit.
Requirements
Who qualifies?
- You are a Turkish national with a residence permit under Section 4(2) AufenthG (or Section 4(5) old version) and meet one of the three conditions of ARB 1/80
Additional requirements
- Path 1 (family reunification): Your spouse or parent has worked without interruption for three years after arrival and you have lived together as a family during this time. Or a parent has worked for a total of three years and you have completed a vocational training in Germany.
- Path 2: You have been working for the same employer for three years.
- Path 3: You have been working in the same profession for four years.
- Your current residence permit must still be valid and you must be registered in Berlin.
How to apply
Send an appointment request via the contact form to Department M 3 of the LEA, preferably 8 weeks before your residence title expires
Gather all documents: passport, passport photo, registration certificate, and employment records
Attend your appointment in person at the State Office for Immigration and bring all documents in original

Exemptions
- Upon presentation of current proof of receiving benefits under SGB II or XII or under the Asylum Seekers Benefits Act
Good to know
You may become self-employed at any stage of ARB 1/80. This applies even if you are still bound to a specific employer. The authority must permit self-employment for you.

You can also receive your residence permit under ARB 1/80 in addition to a settlement permit. This is an exception to the general rule. This way you secure the advantages of both titles.
Aufenthaltserlaubnisse nach § 4 Abs. 2, die ein Aufenthaltsrecht für türkische Staatsangehörige nach ARB 1/80 (deklaratorisch, vgl. E.Türk.1) bescheinigen, können auch neben einem unbefristeten Titel ausgestellt werden.

Your residence permit always states "Daueraufenthalt nach ARB 1/80" (permanent residence under ARB 1/80). This applies regardless of the validity period. This note shows that you are entitled to a permanent right of residence.
