Apply for a Residence Permit for Employment of Certain Nationals

How do you obtain a residence permit for employment as a national of certain countries?
Are you a national of certain countries and want to work in Germany? Then you can obtain a residence permit for employment without needing a qualification as a skilled worker. The authority will decide on your application on a case-by-case basis.
Are you a national of Australia, Israel, Japan, Canada, the Republic of Korea, New Zealand, the United Kingdom of Great Britain and Northern Ireland, or the United States of America? Then you can obtain the residence permit after visa-free entry.
Are you a national of Albania, Andorra, Bosnia and Herzegovina, Kosovo, Monaco, Montenegro, North Macedonia, San Marino, or Serbia? Then you need a national entry visa (D visa) issued by a German foreign mission for the purpose of employment.
You will receive the residence permit for the duration of the consent issued by the Federal Employment Agency. For an extension of the residence permit and when changing employer, you need a new consent from the Federal Employment Agency.
Note: If you are a skilled worker with academic or vocational training, please refer to "Further information" – there you will find the more suitable residence title.
This is how the procedure works: Submit the online application "Temporary residence title for employment". Have your documents ready, ideally as PDFs. You can also photograph and upload them during the application process. Permitted formats are PDF, JPG, JPEG, and PNG. A single file may be at most 7 MB, all files together at most 100 MB. Before you can submit the application, you must pay the processing fee.
At the end, you will receive a PDF confirmation. This certifies that your current residence title (national D visa or residence permit) remains valid – unless your residence title has already expired on the day of application. Be sure to save the confirmation and print it out if possible.
Note for families: If your spouse and children also live with you in Berlin and need a residence permit, do not submit a separate application or book an appointment for them. Simply enter your family members at the corresponding sections in the online application. The State Office for Immigration will contact you regarding their residence permits.
The LEA will then review your application and contact you. If needed, additional documents will be requested. If your application is reviewed positively, you will receive an appointment for a personal interview. Bring all documents in their original form.
Requirements
Who qualifies?
- You can obtain the residence permit if you are a national of Australia, Israel, Japan, Canada, the Republic of Korea, New Zealand, the United Kingdom of Great Britain and Northern Ireland, or the United States of America. You must have entered no more than 90 days ago or already be staying in Germany with a residence permit or another residence title.
- You can also obtain the residence permit if you are a national of Albania, Andorra, Bosnia and Herzegovina, Kosovo, Monaco, Montenegro, North Macedonia, San Marino, or Serbia and have entered with a national D visa. The visa must have been issued by a German foreign mission for your employment under § 19c of the Residence Act in conjunction with § 26 of the Employment Ordinance.
Additional requirements
- The application can be submitted at the earliest 4 months before your D visa or current residence permit for employment expires.
- You need an employment contract. For nationals of Australia, Israel, Japan, Canada, the Republic of Korea, New Zealand, the United Kingdom, and the USA, a draft contract is sufficient. Your employment relationship must be in Germany. For nationals of Albania, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia, and Serbia, the employer must additionally have a place of business in Germany.
- As a rule, the consent of the Federal Employment Agency is required. The LEA requests it in an internal procedure. For nationals of Albania, Andorra, Bosnia and Herzegovina, Kosovo, Monaco, Montenegro, North Macedonia, Serbia, and San Marino, the consent is obtained before entry through the German foreign mission.
- You must have adequate health insurance in Germany – either statutory or comparable private insurance. Foreign health insurance is generally not sufficient.
- There must be no danger to public security or order from you. Even fines or ongoing investigations can prevent issuance. You must not pose a danger to the free democratic basic order and must not be involved in politically or religiously motivated violence.
- You must have your main residence in Berlin. A secondary residence is not sufficient.
- You need a current email address, as the LEA will contact you via email. Also check your spam folder regularly.
- You must consent to the electronic payment procedure. You can pay by credit card (Visa, Mastercard) or PayPal.
How to apply
Submit the online application "Temporary residence title for employment" and have your documents ready as PDF, JPG, JPEG, or PNG
Enter family members directly in the online application if they also need a residence permit
Upload all required documents: colour passport copies, employment contract or draft contract, the completed declaration on the employment relationship form, residence and housing cost documents, and your health insurance
Pay the processing fee by credit card or PayPal and submit your application
Save the PDF confirmation of your application and print it if possible
Wait for the review by the State Office for Immigration and the internal participation procedure of the Federal Employment Agency. Submit additional documents if requested
Attend the personal interview appointment and bring all documents in their original form. Done! If your application is reviewed positively, you will receive your residence permit for the duration of the consent of the Federal Employment Agency

Good to know
After 2 years of employment subject to social insurance contributions, you may take any job. You are then no longer restricted to a specific activity. This rule is stated as a condition on your residence title.

Are you dismissed during the validity of your title? Submit a new application within your notice period. Your stay is then provisionally deemed to continue as permitted (Fiktionswirkung / continuation effect).
Sollte ein Arbeitsverhältnis während der Gültigkeit des Titels gekündigt werden, hat der Arbeitnehmer im Rahmen seiner gesetzlichen Kündigungsfrist Zeit, einen Antrag zu stellen. Dieser entfaltet Fiktionswirkung nach § 81 (4).

Apply for a Residence Permit for Employment of Certain Nationals
If your application is approved, you will receive an appointment. A residence permit as a sticker can be issued on site at the appointment. If issued as an electronic residence title (eAT), it takes 4 to 6 weeks until it can be collected.
