Verfahrensablauf
1. Stellen Sie den Online-Antrag „Aufenthaltserlaubnis für selbstständig oder freiberuflich tätige Personen“
- Bitte halten Sie dafür alle erforderlichen Dokumente möglichst im PDF-Format bereit. Sie können die Dokumente aber auch noch im Antragsprozess mit Ihrem Smartphone oder Tablet fotografieren und hochladen. Folgende Dateiformate sind zugelassen: PDF, JPG, JPEG, und PNG. Die Gesamtgröße Ihrer Dateien darf 100 MB nicht überschreiten. Eine einzelne Datei darf maximal 7 MB groß sein.
- Der Online-Antrag ist umfangreich, sodass das Ausfüllen einige Zeit dauert. Sie können die Antragstellung aber jederzeit unterbrechen, zwischenspeichern und zu einem späteren Zeitpunkt fortführen.
- Bevor Sie den Antrag absenden können, müssen Sie die Bearbeitungsgebühr bezahlen.
- Am Ende erhalten Sie ein PDF-Dokument als Bestätigung Ihres Antrags. Damit wird bescheinigt, dass Ihr aktueller Aufenthaltstitel über das bisherige Gültigkeitsdatum hinaus im Bundesgebiet weiter gültig bleibt. Dies gilt nicht, wenn Sie ein Schengen-Visum (C-Visum) für einen kurzfristigen Aufenthalt besitzen oder Ihr aktueller Aufenthaltstitel am Tag der Antragstellung bereits abgelaufen ist.
- Bitte speichern Sie sich die Bestätigung Ihres Antrages deshalb unbedingt ab und drucken das PDF auch nach Möglichkeit aus.
3. Wenn Ihr Antrag positiv geprüft wurde, erhalten Sie einen Termin zur Vorsprache. Bringen Sie bitte zum Termin vor Ort alle im Einladungsschreiben genannten Unterlagen mit.

How to apply
Put together all required documents: colour passport copies, CV with proof of qualifications, references or funding commitments, company profile, business concept, business plan, financing plan, proof of health insurance, and rental contract or proof of home ownership with a current bank statement.
Collect additional documents that apply to you: power of attorney (if the application is submitted by an authorised representative), copy of your existing residence title, entry stamp and visa or EU residence title (for an initial application), university degree and statement from the university (for university graduates), statement from your previous employer (for skilled workers in research and science), commercial register extract or business registration, and proof of any further regular income (if applicable).
Submit your application for a residence permit for self-employment exclusively online.
Save the PDF you receive after submitting the online application and, if possible, print it out — you''ll need it as confirmation.
Wait for the response from the immigration authority and keep all submitted documents within reach in case further information is needed.
Done! You will receive your residence permit for self-employment if all requirements are met.

Has your residence title expired and the IHK is still reviewing your application? Then you will receive a Fiktionsbescheinigung (provisional residence document) for 3 months. This allows you to stay legally in Germany until the review is completed.
Wird im Einzelfall eine Beteiligung der IHK o. HWK Berlin erforderlich, sind bei Ausländern deren Aufenthaltstitel abgelaufen sind, Fiktionsbescheinigungen nach § 81 für 3 Monate zu erteilen.
