How do you extend your Aufenthaltsgestattung (permission to remain)?
Have you submitted an asylum application in Germany? Then you are permitted to stay for the duration of the asylum procedure. You will receive a temporary certificate of the Aufenthaltsgestattung.
This certificate is extended until the asylum procedure is concluded by a final and non-appealable decision of the Federal Office for Migration and Refugees (BAMF), or until the Aufenthaltsgestattung expires for another reason.
An extension is possible at the earliest 4 weeks before the certificate expires.
Requirements
Who qualifies?
- Your asylum procedure in Germany is still pending. The certificate can only be extended if the Aufenthaltsgestattung has not expired by operation of law. It expires in particular upon a final and non-appealable decision by the BAMF.
Additional requirements
- You must have your primary residence in Berlin. Residence in Berlin for the purpose of the asylum procedure must be permitted. There must be no spatial restriction to the district of another foreigners authority.
- From the age of 18 you must appear in person with an appointment. Make an appointment via the contact form with the responsible department A 2, A 3, or A 4. Minors under 18 do not need to appear in person. For children of compulsory school age, you are asked to present a current school certificate.

Bring a current biometric photo and your previous certificate
Appear in person at the State Office for Immigration

Good to know
The authority extends your Aufenthaltsgestattung certificate itself. You do not need to apply for this separately. The authority does this automatically as long as your asylum procedure is ongoing.

The authority should issue your Aufenthaltsgestattung for 18 months. This is longer than the statutory period of 12 months. The reason is the long processing times at the BAMF.
Vor dem Hintergrund der erheblich angestiegenen Verfahrenslaufzeiten ist daher nach Sinn und Zweck der Regelung des § 63 Abs. 2 S. 2 aus Gründen der Kundenorientierung und der Verwaltungseffizienz ein großzügiger Maßstab anzulegen und sollte die Gestattung mit einer Geltungsdauer von 18 Monaten ausgestellt werden.

If you receive international protection, your periods with an Aufenthaltsgestattung are credited. This counts toward the duration of your lawful residence. This can be important, for example, for a later settlement permit.
In den Fällen der Zuerkennung internationalen Schutzes gem. § 1 Abs. 1 Nr. 2 werden auch die Zeiten einer Aufenthaltsgestattung für die Dauer des rechtmäßigen Aufenthalts angerechnet.
