Where can you get advice on benefits under the Asylum Seekers Benefits Act?
You can get advice at the State Office for Refugee Affairs (LAF). The advice covers general and benefits-related questions, social counselling and assistance with voluntary return and onward migration.
The advice on voluntary return and onward migration is available to all foreign nationals living in Berlin. This includes EU citizens and tourists.
You are entitled to advice if you meet certain residence law requirements. These include, among others, a residence permit under certain sections of the Residence Act or toleration status (Duldung).
Requirements
Who qualifies?
- You are a foreign national, you are actually present in Germany and you hold one of the following residence titles: residence permit under Section 23 para. 1, Section 24, Section 25 para. 4 sentence 1 or Section 25 para. 5 of the Residence Act (provided the toleration status (Duldung) has not been suspended for 18 months), toleration status (Duldung) under Section 60a para. 1 or para. 2 of the Residence Act, or your stay is legally deemed tolerated under Section 71a para. 3 of the Asylum Procedure Act (follow-up or second asylum application).
Additional requirements
- The advice on voluntary return and onward migration is available to all foreign nationals living in Berlin, including EU citizens and tourists.

Good to know
Have you received basic benefits under the AsylbLG for 36 months? Then you have a right to increased assistance under SGB XII. The requirement is that you have not abusively influenced the duration of your stay.
Gemäß § 2 AsylbLG ist Ausländern, die über eine Dauer von 36 Monaten Leistungen nach § 3 AsylbLG erhalten haben, erhöhte Hilfe nach dem SGB XII zu gewähren, wenn diese die Dauer des Aufenthaltes nicht rechtsmissbräuchlich selbst beeinflusst haben.

The independent asylum procedure counselling is voluntary. Whether you participate or not has no effect on the course of your asylum procedure. The outcome is also not influenced by it.
Sie ist unabhängig von dem behördlichen Asylverfahren des BAMF; eine Teilnahme oder Nichtteilnahme haben keine Auswirkungen auf den Ablauf und das Ergebnis des Asylverfahrens.

The asylum procedure counselling can also advise you on possible legal remedies against an authority decision. However, it does not include court representation. For that, you need a lawyer.
Die Beratung kann auch im Hinblick auf mögliche Rechtsmittel gegen die behördliche Entscheidung durchgeführt werden, umfasst jedoch nicht die Prozessvertretung.
