How do you extend your benefits under the Asylum Seekers Benefits Act?
You are already receiving benefits under the Asylum Seekers Benefits Act (AsylbLG)? Then you can apply for an extension (continued payment).
The benefits cover your essential needs: food, accommodation and heating, clothing, healthcare, household goods and consumables, necessary and urgent medical care as well as necessary care during pregnancy and childbirth. You also receive benefits under the Education and Participation Package.
In addition, a cash amount for personal daily needs will continue to be paid.
Requirements
Who qualifies?
- You are already receiving benefits under the Asylum Seekers Benefits Act, you are actually present in Germany and you hold a specific residence title: residence permit under Section 23 para. 1, Section 24, Section 25 para. 4 sentence 1 or Section 25 para. 5 of the Residence Act (provided the toleration status (Duldung) has not been suspended for 18 months), toleration status (Duldung) under Section 60a para. 1 or para. 2 of the Residence Act, or your stay is legally deemed tolerated under Section 71a para. 3 of the Asylum Procedure Act.
How to apply
Prepare your documents: identity and residence documents, registration certificate, health insurance card and proof of income and assets
Submit an application for continued payment at the State Office for Refugee Affairs (LAF)
Done! The LAF will review your application and continue your benefits
Good to know
Have you received basic benefits under Section 3 AsylbLG for 36 months? Then the authority must grant you higher benefits under SGB XII. The requirement is that you have not abusively influenced your stay.
Gemäß § 2 AsylbLG ist Ausländern, die über eine Dauer von 36 Monaten, Leistungen nach § 3 AsylbLG erhalten haben, erhöhte Hilfe nach dem SGB XII zu gewähren, wenn diese die Dauer des Aufenthaltes nicht rechtsmissbräuchlich selbst beeinflusst haben.

Are you subject to an enforceable obligation to leave and is a departure date set? Then you will receive reduced benefits if you do not use the departure opportunity. This particularly applies to cases with organised voluntary departure through the LAF.
§ 1a Abs. 1 AsylbLG erhält ein vollziehbar ausreisepflichtiger Ausländer, der sich im Besitz einer GÜB/PEB II befindet, verringerte Sozialleistungen, wenn für ihn ein Ausreisedatum und eine Reisemöglichkeit feststehen, er die Ausreisemöglichkeit aber nicht wahrnimmt.

Do you receive care allowance? This is not counted as income when calculating your subsistence. It also does not count as income under Section 7 AsylbLG.
Bei der Berechnung des Lebensunterhalts des Pflegebedürftigen gem. § 2 Abs. 3 bleibt das Pflegegeld unberücksichtigt, weil der durch den Pflegebedürftigen zu leistende finanzielle Mehraufwand ohnehin nicht durch das Pflegegeld gesichert ist
