§ 48 AufenthG: Identity Document Obligations
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
What is this section about?
This section explains what identification duties you have as a foreigner in Germany. You must show certain documents to the immigration authority if it asks for them. This section also regulates what happens if you do not have a passport.
Which documents must you show?
You must show, hand over, and temporarily surrender two types of documents to the immigration authority if it asks for them. First: your passport, your passport substitute, or your identity substitute (Ausweisersatz). Second: your residence title or a certificate confirming the suspension of deportation. This is mandatory. But you only have to do this if it is necessary for measures under this law.
Rule for Germans with two nationalities
Are you a German national and do you also have a foreign nationality? Then you must show your foreign passport or passport substitute if the authority asks for it. This applies in two cases.
First case: Your German passport was refused or withdrawn. Or there is an order against you under Section 6 (7) of the Personalausweisgesetz (Identity Card Act). In addition, there must be indications that you intend to leave federal territory. Both parts of this condition must apply.
Second case: The requirements for an exit ban under Section 10 (1) of the Passgesetz (Passport Act) are met. In addition, presenting your foreign passport must be necessary to enforce this exit ban. Here too, both parts must apply.
What applies if you have no passport?
Do you have no passport or passport substitute, and can you also not reasonably obtain one? Then a certificate about your residence title or about the suspension of deportation is enough. This only applies if the certificate contains your personal data and a photo of you. In addition, it must be designated as an identity substitute.
Duty to cooperate: documents to clarify identity
Do you have no valid passport or passport substitute? Then you must cooperate in obtaining an identity document. This is mandatory.
You must also present, hand over, and surrender all documents, records, and data storage devices if the authority asks for them and you possess them. This applies to documents that may be important for establishing your identity and your nationality. It also applies to documents that may be important for examining and enforcing a return to another country.
Do you not fulfill this duty? And are there actual indications that you possess such records or data storage devices? Then the authority can search you personally. It can also search the items in your possession and your home. This is a discretionary decision — the authority does not have to do it, but it may do so in this case.
Only a judge may order a search of your home. In case of imminent danger (Gefahr im Verzug), the immigration authority may also order this itself. Section 58 (9a) applies accordingly.
You must tolerate this search. This means: you may not resist the search.
Reading data storage devices
Do you have no valid passport, passport substitute, or other suitable proof of identity? Then the authority may read out your data storage devices. This also applies to mobile devices and cloud services.
But this is only allowed if it is necessary to establish your identity and nationality. It is also only allowed if it is necessary to examine and enforce a return to another country.
You must provide the authority with the necessary access data for the reading-out process. This is mandatory.
Evaluating the data: narrow limits
The authority may only evaluate the data that has been read out if this is necessary to establish your identity, your nationality, or a possibility of return. In addition, the purpose may not be achievable by milder means. Both requirements must apply.
Are there actual indications that the evaluation would produce findings only from the core area of your private life (Kernbereich privater Lebensgestaltung)? This means: from your entirely private sphere of life. Then the evaluation is prohibited.
The authority may not use findings from the core area of your private life that arise despite this.
The authority must delete records of this without delay. The authority must document in the file that these findings arose and were deleted again.
Only an official qualified to hold judicial office (Befähigung zum Richteramt) may evaluate your data storage devices. This means: this person has legal training like a judge.
Deletion of the data
The authority must delete data that has been read out without delay. This applies as soon as the data is no longer necessary to establish your identity, your nationality, or a possibility of return.
The authority must document the reading-out, evaluation, and deletion of the data.
The authority must also use suitable technical and organizational measures to ensure that no one accesses the data that has been read out without authorization. These measures are based on the requirements of EU data protection law.
Identity substitute instead of passport
Is the passport requirement waived for you under Section 5 (3) or Section 33? Then the authority must issue you an identity substitute. This is mandatory.
The rules on cooperating in obtaining an identity document from the section above still continue to apply.
