§ 23 AufenthV: Exemption for civil aviation personnel

Civil flight crew members (pilots, flight attendants, and other personnel) who hold a flight crew licence do not require a residence title. This applies if they remain at the airport, stay in the area near the airport, or transfer to another airport.
Flight crew members without a flight crew licence may also be exempted from the requirement to hold a residence title. To qualify, they must meet the passport obligation. The border authorities make a discretionary decision on this. A pass is issued as proof of exemption.
(1) Ziviles Flugpersonal, das im Besitz eines Flugbesatzungsausweises ist, ist vom Erfordernis eines Aufenthaltstitels befreit, sofern es
- 1.sich nur auf dem Flughafen, auf dem das Flugzeug zwischengelandet ist oder seinen Flug beendet hat, aufhält,
- 2.sich nur im Gebiet einer in der Nähe des Flughafens gelegenen Gemeinde aufhält oder
- 3.zu einem anderen Flughafen wechselt.
(2) Ziviles Flugpersonal, das nicht im Besitz eines Flugbesatzungsausweises ist, kann für einen in Absatz 1 genannten Aufenthalt vom Erfordernis eines Aufenthaltstitels befreit werden, sofern es die Passpflicht erfüllt. Zuständig sind die mit der Kontrolle des grenzüberschreitenden Verkehrs beauftragten Behörden. Zum Nachweis der Befreiung wird ein Passierschein ausgestellt.
