§ 40 Extension of a visa-free short stay

Nationals of certain states who are exempt from the visa requirement can apply for a residence permit (Aufenthaltserlaubnis) after entry. This permit is valid for a further stay of up to 90 days after the short stay.
Two conditions must be met:
- There must be an exceptional case. These are special reasons such as force majeure or humanitarian reasons.
- You must not carry out any gainful employment in Germany. Exception: Certain short-term activities are permitted.
Staatsangehörige der in Anhang II der Verordnung (EU) 2018/1806 aufgeführten Staaten können nach der Einreise eine Aufenthaltserlaubnis für einen weiteren Aufenthalt von längstens 90 Tagen, der sich an einen Kurzaufenthalt anschließt, einholen, wenn
- 1.ein Ausnahmefall im Sinne des Artikels 20 Abs. 2 des Schengener Durchführungsübereinkommens vorliegt und
- 2.der Ausländer im Bundesgebiet keine Erwerbstätigkeit mit Ausnahme der in § 17 Abs. 2 genannten Tätigkeiten ausübt.
