§ 16 Business travellers

Business travelers
For business travelers, the immigration office does not need approval from the Federal Employment Agency. This applies to persons who:
- Work abroad in the commercial sector for an employer based in Germany
- Conduct meetings or negotiations in Germany for an employer based abroad, prepare or conclude contracts, or supervise contract execution
- Establish, supervise, or manage a German branch for an employer based abroad
Conditions:
- You maintain your usual residence abroad
- You stay in Germany for no more than 90 days within 180 days in total
Keiner Zustimmung bedarf die Erteilung eines Aufenthaltstitels an Personen, die
- 1.bei einem Arbeitgeber mit Sitz im Inland im kaufmännischen Bereich im Ausland beschäftigt werden,
- 2.für einen Arbeitgeber mit Sitz im Ausland Besprechungen oder Verhandlungen im Inland führen, Vertragsangebote erstellen, Verträge schließen oder die Durchführung eines Vertrages überwachen oder
- 3.für einen Arbeitgeber mit Sitz im Ausland einen inländischen Unternehmensteil gründen, überwachen oder steuern, und die sich im Rahmen ihrer Beschäftigung unter Beibehaltung ihres gewöhnlichen Aufenthaltes im Ausland insgesamt nicht länger als 90 Tage innerhalb eines Zeitraums von 180 Tagen im Inland aufhalten.
