Administrative Offences
Anyone who violates Section 38 by carrying out recruitment or job placement commits an administrative offence (Ordnungswidrigkeit). This applies to both intentional and negligent conduct. The administrative offence is punishable under Section 404(2) number 9 of the Third Book of the Social Code.
Ordnungswidrig im Sinne des § 404 Absatz 2 Nummer 9 des Dritten Buches Sozialgesetzbuch handelt, wer vorsätzlich oder fahrlässig entgegen § 38 eine Anwerbung oder Arbeitsvermittlung durchführt.
