§ 6 BeschV: Employment based on extensive practical professional experience

Working with a lot of professional experience
What is this about? This section applies to foreign nationals with a lot of professional experience. It is called: Employment based on extensive practical professional experience. It is part of the Ordinance on the Employment of Foreign Nationals (BeschV).
Can you get approval to work? You can get approval for qualified employment in Germany. The word "can" means: the authority decides your case. It is not a guarantee. For the authority to be able to decide this, you must fulfill three conditions.
Condition 1: Your professional experience You need at least two years of professional experience. You must have gained this professional experience in the last five years. The professional experience must qualify you for the new employment.
Condition 2: Your salary Your job must have a certain minimum salary. The salary must be at least 45 percent of the annual Beitragsbemessungsgrenze (contribution assessment ceiling) in the general pension insurance. The Beitragsbemessungsgrenze is a value from the pension insurance system. A job offer with this salary is also sufficient.
Exception for collective agreements Is your employer bound by a collective agreement? Does he pay you according to the collectively agreed working conditions that apply at his company? Then the salary condition from Condition 2 does not apply to you.
Condition 3: Your qualification You need one of three possible qualifications.
Qualification A: A foreign professional qualification. The country where you obtained this qualification must officially recognize it. The training for it must have lasted at least two years.
Qualification B: A foreign university degree. The country where you obtained this degree must officially recognize it.
Qualification C: A vocational qualification obtained abroad through training. This training must, in content, duration, and implementation, meet the requirements that the German Vocational Training Act (Berufsbildungsgesetz) sets for vocational training. The training must be suitable for teaching the professional skills needed for a German training occupation under the Vocational Training Act or the Trade and Crafts Code (Handwerksordnung). A German Chamber of Commerce Abroad (Auslandshandelskammer) must have issued this qualification.
Exception for IT occupations Do you work in an information and communication technology occupation? Then Condition 3, the qualification, does not apply to you.
Your obligation for Qualification A or B Do you have Qualification A or Qualification B? Then you must have this confirmed by a competent body in Germany. This body checks whether your qualification meets the conditions.
Confirmation for Qualification C For Qualification C, it must be confirmed that your training abroad meets the requirements. This confirmation is given to the body that issued your qualification. This body applies for the confirmation. It bears the costs itself.
What does not apply here? Section 9 of the Ordinance on the Employment of Foreign Nationals does not apply to this section.
Who sets the minimum salary? The Federal Ministry of the Interior and Community (Bundesministerium des Innern und für Heimat) must announce the minimum salary from Condition 2 anew every year. It must publish this in the Bundesanzeiger by December 31 of the previous year. The Bundesanzeiger is an official publication gazette.
(1) Die Zustimmung zur Ausübung einer inländischen qualifizierten Beschäftigung kann Ausländerinnen und Ausländern erteilt werden, wenn die Ausländerin oder der Ausländer über Folgendes verfügt:
- 1.eine in den letzten fünf Jahren erworbene, mindestens zweijährige Berufserfahrung, die die Ausländerin oder den Ausländer zu der Beschäftigung befähigt,
- 2.einen Arbeitsplatz, bei dem die Höhe des Gehalts mindestens 45 Prozent der jährlichen Beitragsbemessungsgrenze in der allgemeinen Rentenversicherung beträgt, oder ein Angebot für einen solchen Arbeitsplatz und
- 3.eine der folgenden Qualifikationen:
- a)eine ausländische Berufsqualifikation, die von dem Staat, in dem sie erworben wurde, staatlich anerkannt ist und deren Erlangung eine Ausbildungsdauer von mindestens zwei Jahren vorausgesetzt hat,
- b)einen ausländischen Hochschulabschluss, der von dem Staat, in dem er erworben wurde, staatlich anerkannt ist, oder
- c)einen im Ausland erworbenen Berufsabschluss, der durch eine Ausbildung erworben wurde, die nach Inhalt, Dauer und der Art ihrer Durchführung die Anforderungen des Berufsbildungsgesetzes an eine Berufsausbildung einhält und geeignet ist, die notwendige berufliche Handlungsfähigkeit für einen Ausbildungsberuf nach dem Berufsbildungsgesetz oder der Handwerksordnung zu vermitteln, und der von einer deutschen Auslandshandelskammer erteilt worden ist. Ist der Arbeitgeber tarifgebunden und beschäftigt er die Ausländerin oder den Ausländer zu den bei ihm geltenden tariflichen Arbeitsbedingungen, findet die Gehaltsschwelle nach Satz 1 Nummer 2 Halbsatz 2 keine Anwendung. In Berufen auf dem Gebiet der Informations- und Kommunikationstechnologie findet Satz 1 Nummer 3 keine Anwendung. Der Ausländer ist verpflichtet, sich das Vorliegen der Voraussetzungen nach Satz 1 Nummer 3 Buchstabe a oder b von einer fachkundigen inländischen Stelle bestätigen zu lassen. Das Vorliegen der nach Satz 1 Nummer 3 Buchstabe c an die Ausbildung im Ausland gestellten Anforderungen ist gegenüber der abschlusserteilenden Stelle auf deren Antrag und Kosten zu bestätigen.
(2) § 9 findet keine Anwendung. Das Bundesministerium des Innern und für Heimat gibt das Mindestgehalt nach Absatz 1 Satz 1 für jedes Kalenderjahr jeweils bis zum 31. Dezember des Vorjahres im Bundesanzeiger bekannt.
