§ 9 BeschV: Employment based on prior employment periods or extended previous residence
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
Who does this rule apply to?
This rule applies to you if you hold a residence permit.
When do you not need consent for your employment?
You do not need consent for your employment. This applies if you meet one of two conditions.
Condition 1: You have lawfully worked in insurance-obligated employment in the federal territory for two years.
Condition 2: You have resided in the federal territory continuously for three years. This includes time spent residing with a permit. It also includes time spent residing under toleration status (Duldung). And it includes time spent residing with an Aufenthaltsgestattung (permission to stay during an asylum procedure). Interruption periods are taken into account as set out in Section 51 (1) number 7 of the Residence Act.
Which periods do NOT count towards the two years in condition 1?
Three types of periods do not count towards your employment period from condition 1.
Periods of employment do not count if that employment took place before the point in time when you had given up your habitual residence and left the federal territory.
Periods of employment do not count if that employment was time-limited under the Residence Act or under this Ordinance.
Periods of employment do not count if you did not need consent for that employment on the basis of an intergovernmental agreement.
What special rules apply to the three years in condition 2?
Two special rules apply to the period of residence from condition 2.
Rule 1: Periods of residence under Section 16b of the Residence Act count only by half. And they count for a maximum of up to two years.
Rule 2: Periods of employment that are time-limited under the Residence Act or under this Ordinance are added to your period of residence. But this applies only under one condition: you must have obtained a residence title for a purpose other than the employment afterwards.
