§ 3a FreizügG/EU: Residence of closely associated persons
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This rule applies to people who are close to a Union citizen.
The law distinguishes three groups of close persons. These groups are listed in Section 1 paragraph 2 number 4, letters a, b and c.
This rule only applies to you if you are not a Union citizen yourself.
This rule also only applies if you do not have a right of free movement under Section 3 or Section 4.
You can submit an application. Then you can get the right to enter and stay in Germany. The authority decides on your application. This is not a guarantee.
Different conditions apply to the three groups.
Group 1 (letter a): Here there are three possible conditions. Only one of them must be met.
Condition 1: The Union citizen supports you financially. This support must be permanent, not just temporary. As a rule, the support must already have existed for at least two years. This applies at the time you submit your first application.
Condition 2: You have lived with the Union citizen in a shared household. This was in the country where you lived before you moved to Germany, or where you still live. This shared household must have existed for at least two years.
Condition 3: You have serious health problems that are not just temporary. Because of this, the Union citizen must personally care for you. This is absolutely necessary at the time of your application.
Group 2 (letter b): The Union citizen wants to live together with you in Germany in a family unit for a longer period of time. In addition, you are dependent on the Union citizen. Both conditions must be met.
Group 3 (letter c): The Union citizen wants to live together with you in Germany permanently, not just temporarily.
How the authority decides:
The authority must examine your personal situation closely.
The authority must take into account how close your relationship with the Union citizen is.
The authority must also take other points into account. For example: How dependent are you on the Union citizen, financially or physically? How close is your family relationship?
The authority uses this to check whether your stay is really necessary. This means: necessary for one of the reasons named above under the three groups.
Additional rule: Section 3 paragraph 2 of this law also applies to you.
