Criminal Offences
Imprisonment up to 3 years or a fine
It is a criminal offence to provide incorrect or incomplete information in order to obtain:
- a residence card
- a permanent residence card
- a certificate of the right of permanent residence
- a residence document-GB or a residence document for cross-border commuters-GB
It is also a criminal offence to knowingly use a document obtained in this way for deception.
Imprisonment up to 1 year or a fine
It is a criminal offence to enter or remain in the federal territory despite the loss of the right of free movement under Section 7(2).
Objects connected with the criminal offence may be confiscated.
(1) Mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe wird bestraft, wer unrichtige oder unvollständige Angaben macht oder benutzt, um für sich oder einen anderen eine Aufenthaltskarte, eine Daueraufenthaltskarte, eine Bescheinigung über das Daueraufenthaltsrecht, ein Aufenthaltsdokument-GB oder ein Aufenthaltsdokument für Grenzgänger-GB zu beschaffen oder eine so beschaffte Urkunde wissentlich zur Täuschung im Rechtsverkehr gebraucht.
(2) Mit Freiheitsstrafe bis zu einem Jahr oder mit Geldstrafe wird bestraft, wer entgegen § 7 Abs. 2 Satz 1 in das Bundesgebiet einreist oder sich darin aufhält.
(3) Gegenstände, auf die sich eine Straftat nach Absatz 1 bezieht, können eingezogen werden.
