§ 26 StAG: Renunciation

Renouncing German Citizenship
You have German citizenship and one or more other citizenships as well. Then you can renounce your German citizenship. This is your own decision. But there are fixed rules for it.
How you declare the renunciation
You must declare the renunciation in writing. A spoken declaration is not enough.
Your declaration of renunciation also requires an approval. The competent citizenship authority grants this approval. This means: without this approval, your renunciation does not become effective.
When the authority must refuse the approval
In certain cases, the authority must refuse the approval. This is not a free decision of the authority. It is the authority's duty.
Case 1: You are in public service. You are a civil servant (Beamter or Beamtin), a judge, or a soldier of the Bundeswehr. Or you are in a public-law service or official relationship (öffentlich-rechtliches Dienst- oder Amtsverhältnis) for another reason. Then the authority must refuse. This applies for as long as your service or official relationship has not ended. Exception: If you are only active in an honorary capacity, this duty to refuse does not apply to you.
Case 2: You are subject to military conscription. Then the authority must refuse. This applies for as long as the Federal Ministry of Defence — or a body it has designated — has not declared: there are no objections to your renunciation.
This duty to refuse for conscripts does not apply, however, if one of the following two points applies to you:
- You have habitually lived abroad for at least ten years.
- As a conscript, you have already performed military service in one of the states whose citizenship you hold.
If one of these points applies to you, the duty to refuse for conscripts does not apply to you.
When you lose your German citizenship
You lose your German citizenship only at one specific moment: when the competent citizenship authority hands you the certificate of renunciation. Before that, you remain German.
Special rules for certain persons
Adults without legal capacity: Are you an adult and, under the German Civil Code (Bürgerliches Gesetzbuch), without legal capacity? Or do you have a supervisor (Betreuer), and has a consent requirement (Einwilligungsvorbehalt) been ordered for your affairs under Section 1825 of the German Civil Code? Then only a person who is legally authorised to represent you can declare the renunciation for you. This means: you cannot make this declaration yourself. This person also requires an approval from the competent German guardianship court (Betreuungsgericht).
Minors: Are you a minor? Then only your legal representative can declare the renunciation for you. This person also requires an approval from the competent German family court (Familiengericht).
Do you, as a minor, have legal capacity to act under Section 34 sentence 1? Then you must consent to the declaration of renunciation yourself. Without your consent, it cannot proceed.
