§ 7 Asylum Seekers' Benefits Act (AsylbLG) – Income and Assets
When must you use your own money first?
You receive benefits under this Act. Before you receive these benefits, you must use up your own income and your own assets first. This also applies to your family members if they live with you in the same household. For the calculation, § 20 of the Twelfth Book of the Social Code (Sozialgesetzbuch) also applies accordingly.
If you live in a facility
Some benefit recipients live in a facility. There, you receive benefits in kind, for example accommodation or meals, directly. Do you live in such a facility, and do you or your family members have income or assets? Then you must repay the costs to the cost-bearer (Kostenträger). This applies to you and to your family members. The amount is based on the benefits under § 3a paragraph 2. You must also repay the costs for accommodation, heating, and household energy. For accommodation, heating, and household energy, the federal states (Bundesländer) can set fixed flat-rate amounts. The federal states can also hand over this task to the competent authority. This is a decision of the federal states, not an obligation.
What does NOT count as income?
Some receipts do not count as income. These receipts are not included when it is checked how much income you have:
- Benefits that you receive under this Act.
- Benefits under laws where the Fourteenth Book of the Social Code applies accordingly.
- Pensions or allowances under the Federal Compensation Act (Bundesentschädigungsgesetz) for damage to life, body, or health — up to the amount of comparable benefits under the Fourteenth Book of the Social Code.
- Compensation for damage that is not financial damage, under § 253 paragraph 2 of the Civil Code (Bürgerliches Gesetzbuch).
- An expense allowance under § 5 paragraph 2.
- An additional-expense allowance that you receive as part of a refugee integration measure under § 5a.
- A travel-cost subsidy from the Federal Office for Migration and Refugees. You receive this subsidy so that you can take part in an integration course under § 43 of the Residence Act (Aufenthaltsgesetz) or in the job-related German language support under § 45a of the Residence Act.
If you work: What is left of your wages?
Do you work? Then your earned income does not have to be counted in full. 25 out of 100 (25 percent) of your earned income does not have to be counted. But this exemption is capped: the limit is at most 50 out of 100 (50 percent) of the relevant need level (Bedarfsstufe). The need level is made up of the amount of money for your necessary personal needs under § 3a paragraph 1 and the necessary need under § 3a paragraph 2, each together with § 3a paragraph 4.
Do you additionally receive tax-free earnings from an activity — for example under § 3 number 12, 26, 26a, or 26b of the Income Tax Act (Einkommensteuergesetz)? Then, instead of the 25-percent rule, a different rule applies: an amount of up to one-twelfth of the amount named in § 3 number 26 of the Income Tax Act then does not have to be counted as income each month.
From your income under paragraph 1 sentence 1, the following things must also be deducted:
- Taxes paid on your income.
- Mandatory contributions to social insurance, including contributions to employment promotion.
- Contributions to public or private insurance or similar institutions, if these contributions are required by law.
- Necessary expenses connected with earning your income.
In the cases of the special rule for tax-free earnings, is your income higher than one-twelfth of the named amount per month? Then a restriction applies to the last two points (insurance contributions and necessary expenses): these are only deducted if you prove that these costs together exceed the amount of one-twelfth per month. The possibility of deducting the other amounts (taxes and mandatory social insurance contributions) from your earned income remains unaffected by this.
If someone else owes you money
Do you have a legal entitlement (Anspruch) against another person — for example because this person owes you money? Then the competent authority may transfer this entitlement to itself. This is called Überleitung (transfer of claim), in accordance with § 93 of the Twelfth Book of the Social Code. This is a decision of the authority. It does not happen automatically.
Your exempt amount for assets
From your assets under paragraph 1 sentence 1, an exempt amount (Freibetrag) of 200 euros must be deducted. You receive this exempt amount for yourself. Every family member who lives with you in the same household also receives their own exempt amount of 200 euros.
In addition, some assets are not counted at all. This applies to items that you absolutely need in order to start or continue vocational training or gainful employment. The same applies to compensation payments under laws where Chapter 9 of the Fourteenth Book of the Social Code applies accordingly.
(1) Einkommen und Vermögen, über das verfügt werden kann, sind von dem Leistungsberechtigten und seinen Familienangehörigen, die im selben Haushalt leben, vor Eintritt von Leistungen nach diesem Gesetz aufzubrauchen. § 20 des Zwölften Buches Sozialgesetzbuch findet entsprechende Anwendung. Bei der Unterbringung in einer Einrichtung, in der Sachleistungen gewährt werden, haben Leistungsberechtigte, soweit Einkommen und Vermögen im Sinne des Satzes 1 vorhanden sind, für erhaltene Leistungen dem Kostenträger für sich und ihre Familienangehörigen die Kosten in entsprechender Höhe der in § 3a Absatz 2 genannten Leistungen sowie die Kosten der Unterkunft, Heizung und Haushaltsenergie zu erstatten; für die Kosten der Unterkunft, Heizung und Haushaltsenergie können die Länder Pauschalbeträge festsetzen oder die zuständige Behörde dazu ermächtigen.
(2) Nicht als Einkommen nach Absatz 1 zu berücksichtigen sind:
- 1.Leistungen nach diesem Gesetz,
- 2.Leistungen nach Gesetzen, die eine entsprechende Anwendung des Vierzehnten Buches Sozialgesetzbuch vorsehen,
- 3.Renten oder Beihilfen nach dem Bundesentschädigungsgesetz für Schaden an Leben sowie an Körper oder Gesundheit bis zur Höhe der vergleichbaren Leistungen nach dem Vierzehnten Buch Sozialgesetzbuch,
- 4.eine Entschädigung, die wegen eines Schadens, der nicht Vermögensschaden ist, nach § 253 Absatz 2 des Bürgerlichen Gesetzbuchs geleistet wird,
- 5.eine Aufwandsentschädigung nach § 5 Absatz 2,
- 6.eine Mehraufwandsentschädigung, die Leistungsberechtigten im Rahmen einer Flüchtlingsintegrationsmaßnahme im Sinne von § 5a ausgezahlt wird und
(3) Einkommen aus Erwerbstätigkeit bleiben bei Anwendung des Absatzes 1 in Höhe von 25 vom Hundert außer Betracht, höchstens jedoch in Höhe von 50 vom Hundert der maßgeblichen Bedarfsstufe des Geldbetrags zur Deckung aller notwendigen persönlichen Bedarfe nach § 3a Absatz 1 und des notwendigen Bedarfs nach § 3a Absatz 2, jeweils in Verbindung mit § 3a Absatz 4. Erhält eine leistungsberechtigte Person mindestens aus einer Tätigkeit Bezüge oder Einnahmen, die nach § 3 Nummer 12, 26, 26a oder 26b des Einkommensteuergesetzes steuerfrei sind, ist abweichend von Satz 1 ein Betrag von bis zu einem Zwölftel des in § 3 Nummer 26 des Einkommensteuergesetzes genannten Betrags monatlich nicht als Einkommen zu berücksichtigen. Von den Einkommen nach Absatz 1 Satz 1 sind ferner abzusetzen
- 1.auf das Einkommen entrichtete Steuern,
- 2.Pflichtbeiträge zur Sozialversicherung einschließlich der Beiträge zur Arbeitsförderung,
- 3.Beiträge zu öffentlichen oder privaten Versicherungen oder ähnlichen Einrichtungen, soweit diese Beiträge gesetzlich vorgeschrieben sind, und
- 4.die mit der Erzielung des Einkommens verbundenen notwendigen Ausgaben. Übersteigt das Einkommen in den Fällen von Satz 2 den Betrag von einem Zwölftel des in § 3 Nummer 26 des Einkommensteuergesetzes genannten Betrags monatlich, findet Satz 3 Nummer 3 und 4 mit der Maßgabe Anwendung, dass eine Absetzung der dort genannten Aufwendungen nur erfolgt, soweit die oder der Leistungsberechtigte nachweist, dass die Summe dieser Aufwendungen den Betrag von einem Zwölftel des in § 3 Nummer 26 des Einkommensteuergesetzes genannten Betrags monatlich übersteigt. Die Möglichkeit zur Absetzung der Beträge nach Satz 3 von Einkommen aus Erwerbstätigkeit bleibt unberührt.
(4) Hat ein Leistungsberechtigter einen Anspruch gegen einen anderen, so kann die zuständige Behörde den Anspruch in entsprechender Anwendung des § 93 des Zwölften Buches Sozialgesetzbuch auf sich überleiten.
(5) Von dem Vermögen nach Absatz 1 Satz 1 ist für den Leistungsberechtigten und seine Familienangehörigen, die im selben Haushalt leben, jeweils ein Freibetrag in Höhe von 200 Euro abzusetzen. Bei der Anwendung von Absatz 1 bleiben ferner Vermögensgegenstände außer Betracht, die zur Aufnahme oder Fortsetzung der Berufsausbildung oder der Erwerbstätigkeit unentbehrlich sind. Dasselbe gilt für Entschädigungszahlungen nach Gesetzen, die eine entsprechende Anwendung des Kapitels 9 des Vierzehnten Buches Sozialgesetzbuch vorsehen.
