§ 12a AufenthG: Residence Requirement

What is the residence rule?
Do you receive international protection under Regulation (EU) 2024/1347? Or do you receive a residence permit for the first time under Section 22, Section 23, Section 24 (1), or Section 25 (3)? Then you must live in a specific federal state for three years. The law calls this permanent place of residence your "habitual residence." The three years begin with your recognition or with the granting of your residence permit. You must live in the federal state you were assigned to for your asylum procedure or your admission procedure. Or you must live in the federal state you were allocated to under Section 24 (3). This duty exists to help you with your permanent integration into living conditions in Germany.
When does the residence duty not apply?
The residence duty does not apply if one of the following people takes up, or has taken up, employment subject to social security contributions of at least 15 hours per week: you yourself, your spouse, your registered life partner, or your minor unmarried child, if you live together as a family and are related. This employment must bring in at least as much income as the average monthly need for a single person under Section 20 and Section 22 of Book Two of the Social Code.
The residence duty also does not apply if one of these people instead starts or has started vocational training, or is in a course of study or a training relationship, or starts, has started, or has completed an integration course under Section 43, or starts, has started, or has completed a professional language course under Section 45a, or starts, has started, or has completed a qualification measure of at least three months that leads to professional recognition, or starts, has started, or has completed a further training measure under Section 81 or Section 82 of Book Three of the Social Code.
Important restriction: This exception only applies if the course or measure cannot also take place or continue without delay at the place where you would otherwise be required to live.
What happens if you do not fulfil the duty?
The authority can extend the three-year period. It extends the period by the amount of time during which you did not comply with your residence duty. This is a discretionary decision (a "can" decision): the authority decides on a case-by-case basis.
Do the reasons for the exception (for example a job, training, or a course) fall away again within three months? Then the residence duty continues to apply — in the federal state you have since moved to.
Special rule for turning 18
Was your place of residence previously determined by an allocation or assignment decision under Book Eight of the Social Code, because you were a minor? As soon as you turn 18, the residence duty from the first paragraph applies to you. The duty then applies in the federal state you were last assigned to by an allocation or assignment decision. The time you already spent there before turning 18 — counted from the recognition of international protection under Regulation (EU) 2024/1347, or from the first granting of a residence title under Section 22, Section 23, Section 24 (1), or Section 25 (3) — counts toward the three-year period.
Residence at a specific place
Do you live in a reception facility or other temporary accommodation, and are you subject to the residence duty? Then the authority can require you, within six months of your recognition, admission, or the granting of your residence permit under Section 24 (1), to live at a specific place. This is a discretionary decision (a "can" decision), not an automatic duty. The aim is to provide you with adequate housing. The authority may only order this if it does not stand in the way of your permanent integration into living conditions in Germany. This order applies for no longer than the end of your three-year period. Was the authority unable, in an individual case, to assign you adequate housing within the first six months? Then it can do so once, within a further six months.
Determining a place to promote integration
The authority can also — within six months of recognition or the first granting of the residence permit, and for no longer than the end of your three-year period — require you to live at a specific place. This too is a discretionary decision (a "can" decision), so that your permanent integration into living conditions in Germany is promoted. The authority may only order this if it makes it easier to achieve one or more of these three goals: first, providing you with adequate housing; second, your acquisition of sufficient spoken German at level B1 of the Common European Framework of Reference for Languages; third, your taking up employment — taking into account the situation on the local training and labour market.
When making this decision, the authority can also take other local circumstances into account that promote your integration. This applies in particular to the availability of education and childcare services for minor children and young people.
Prohibition of a specific place
The authority can instead also require you not to take up residence at a specific place. This too is a discretionary decision (a "can" decision). This order applies for no longer than the end of your three-year period. The aim is to avoid social and societal exclusion. This applies in particular where it is to be expected that you would not use German at that place as the essential everyday language — that is, not as the language spoken most in daily life there. The authority must take into account the situation on the local training and labour market when making this decision. This is a mandatory duty, not a discretionary rule.
When must the authority lift a requirement?
If you submit an application, the authority must lift a requirement or assignment based on one of the four preceding rules — this is a legal entitlement, not a discretionary decision by the authority — if one of these reasons applies:
Reason one: You prove that at another place — or, in the case of a prohibition, precisely at the place where you may not live — employment subject to social security contributions, an income that predominantly covers your living costs, or a training or study place is available for you, your spouse, your registered life partner, or a minor unmarried child who is related to you and lives with you as a family. Or you prove that an integration course, a professional language course, a qualification measure of at least three months with professional recognition, or a further training measure is available soon for one of these people. Or your spouse, your registered life partner, or a minor unmarried child you previously lived with as a family now lives at a different place of residence.
Reason two: There is a particular hardship that must be avoided. A hardship exists in particular if the responsible youth welfare office assesses that child and youth welfare services with a local connection would be impaired. A hardship also exists if, for other urgent personal reasons, another federal state has agreed to take you in. And a hardship exists if comparable unreasonable restrictions arise for you for other reasons.
Does reason one (the employment, the income, or the training or study place) fall away again within three months of the requirement being lifted? Then the original residence duty continues to apply — in the federal state you have moved to.
If the requirement is lifted because of a hardship, the authority must impose a new requirement on you, under the rule on promoting integration or the prohibition of a specific place, that does justice to your interests. This new requirement applies for no longer than the end of your three-year period.
Family reunification
Does a family member join you, and are you yourself subject to a requirement or assignment under one of the four preceding rules? Then this requirement or assignment generally also applies to the family member joining you — for no longer than the end of your three-year period. However, the responsible authority can also order something different for the family member. The rules on lifting a requirement apply accordingly to family members joining you.
Who does this rule not apply to?
None of these rules apply to you if your recognition or your first granting of the residence permit took place before 1 January 2016.
Objection and legal action
Do you file an objection or take legal action against a requirement — that is, against an order for a specific place of residence, a prohibition of a specific place, or a determination of a place to promote integration? This does not change the immediate effect of the requirement. The law calls this "no suspensive effect": the requirement continues to apply immediately, even while you are challenging it.
Rules of the federal states
The federal states can set out further details through a state government ordinance or other state-law rules. This is a discretionary rule (a "can" rule) for the states — they do not have to do this. Possible rules concern: distribution within the federal state, the procedure for assignments and requirements regarding a specific place of residence, the requirements for adequate housing and how you must prove this, the way in which you must prove employment subject to social security contributions, an income that covers your living costs, or a training or study place, as well as the duty of the responsible municipality to admit you, and the admission procedure.
Special case of particularly justified individual cases
Section 12 (2) sentence 2 remains unaffected by this residence rule. This means: this other provision continues to apply in addition. Under it, the authority can issue further residence-restricting conditions in particularly justified individual cases.
(1) Zur Förderung seiner nachhaltigen Integration in die Lebensverhältnisse der Bundesrepublik Deutschland ist ein Ausländer, dem internationaler Schutz nach der Verordnung (EU) 2024/1347 zuerkannt worden ist oder dem nach §§ 22, 23, 24 Absatz 1 oder 25 Absatz 3 erstmalig eine Aufenthaltserlaubnis erteilt worden ist, verpflichtet, für den Zeitraum von drei Jahren ab Anerkennung oder Erteilung der Aufenthaltserlaubnis in dem Land seinen gewöhnlichen Aufenthalt (Wohnsitz) zu nehmen, in das er zur Durchführung seines Asylverfahrens oder im Rahmen seines Aufnahmeverfahrens zugewiesen oder gemäß § 24 Absatz 3 verteilt worden ist. Satz 1 findet keine Anwendung, wenn der Ausländer, sein Ehegatte, eingetragener Lebenspartner oder ein minderjähriges lediges Kind, mit dem er verwandt ist und in familiärer Lebensgemeinschaft lebt, eine sozialversicherungspflichtige Beschäftigung mit einem Umfang von mindestens 15 Stunden wöchentlich aufnimmt oder aufgenommen hat, durch die diese Person mindestens über ein Einkommen in Höhe des monatlichen durchschnittlichen Bedarfs nach den §§ 20 und 22 des Zweiten Buches Sozialgesetzbuch für eine Einzelperson verfügt, oder eine Berufsausbildung aufnimmt oder aufgenommen hat oder in einem Studien- oder Ausbildungsverhältnis steht oder einen Integrationskurs nach § 43, einen Berufssprachkurs nach § 45a, eine Qualifizierungsmaßnahme von einer Dauer von mindestens drei Monaten, die zu einer Berufsanerkennung führt, oder eine Weiterbildungsmaßnahme nach den §§ 81 und 82 des Dritten Buches Sozialgesetzbuch aufnimmt, aufgenommen oder abgeschlossen hat, sofern der Kurs oder die Maßnahme nicht an dem nach Satz 1 verpflichtenden Wohnsitz ohne Verzögerung durchgeführt oder fortgesetzt werden kann. Die Frist nach Satz 1 kann um den Zeitraum verlängert werden, für den der Ausländer seiner nach Satz 1 bestehenden Verpflichtung nicht nachkommt. Fallen die Gründe nach Satz 2 innerhalb von drei Monaten weg, wirkt die Verpflichtung zur Wohnsitznahme nach Satz 1 in dem Land fort, in das der Ausländer seinen Wohnsitz verlegt hat.
(1a) Wird ein Ausländer, dessen gewöhnlicher Aufenthalt durch eine Verteilungs- oder Zuweisungsentscheidung nach dem Achten Buch Sozialgesetzbuch bestimmt wird, volljährig, findet ab Eintritt der Volljährigkeit Absatz 1 Anwendung; die Wohnsitzverpflichtung erwächst in dem Land, in das er zuletzt durch Verteilungs- oder Zuweisungsentscheidung zugewiesen wurde. Die bis zur Volljährigkeit verbrachte Aufenthaltszeit ab Zuerkennung internationalen Schutzes nach der Verordnung (EU) 2024/1347 oder nach erstmaliger Erteilung eines Aufenthaltstitels nach den §§ 22, 23, 24 Absatz 1 oder 25 Absatz 3 wird auf die Frist nach Absatz 1 Satz 1 angerechnet.
(2) Ein Ausländer, der der Verpflichtung nach Absatz 1 unterliegt und der in einer Aufnahmeeinrichtung oder anderen vorübergehenden Unterkunft wohnt, kann innerhalb von sechs Monaten nach Anerkennung, Aufnahme oder Erteilung einer Aufenthaltserlaubnis nach § 24 Absatz 1 längstens bis zum Ablauf der nach Absatz 1 geltenden Frist zu seiner Versorgung mit angemessenem Wohnraum verpflichtet werden, seinen Wohnsitz an einem bestimmten Ort zu nehmen, wenn dies der Förderung seiner nachhaltigen Integration in die Lebensverhältnisse der Bundesrepublik Deutschland nicht entgegensteht. Soweit im Einzelfall eine Zuweisung angemessenen Wohnraums innerhalb von sechs Monaten nicht möglich war, kann eine Zuweisung nach Satz 1 innerhalb von einmalig weiteren sechs Monaten erfolgen.
(3) Zur Förderung seiner nachhaltigen Integration in die Lebensverhältnisse der Bundesrepublik Deutschland kann ein Ausländer, der der Verpflichtung nach Absatz 1 unterliegt, innerhalb von sechs Monaten nach Anerkennung oder erstmaliger Erteilung der Aufenthaltserlaubnis verpflichtet werden, längstens bis zum Ablauf der nach Absatz 1 geltenden Frist seinen Wohnsitz an einem bestimmten Ort zu nehmen, wenn dadurch
- 1.seine Versorgung mit angemessenem Wohnraum,
- 2.sein Erwerb ausreichender mündlicher Deutschkenntnisse im Sinne des Niveaus B1 des Gemeinsamen Europäischen Referenzrahmens für Sprachen und
- 3.unter Berücksichtigung der örtlichen Lage am Ausbildungs- und Arbeitsmarkt die Aufnahme einer Erwerbstätigkeit erleichtert werden kann. Bei der Entscheidung nach Satz 1 können zudem besondere örtliche, die Integration fördernde Umstände berücksichtigt werden, insbesondere die Verfügbarkeit von Bildungs- und Betreuungsangeboten für minderjährige Kinder und Jugendliche.
(4) Ein Ausländer, der der Verpflichtung nach Absatz 1 unterliegt, kann zur Vermeidung von sozialer und gesellschaftlicher Ausgrenzung bis zum Ablauf der nach Absatz 1 geltenden Frist auch verpflichtet werden, seinen Wohnsitz nicht an einem bestimmten Ort zu nehmen, insbesondere wenn zu erwarten ist, dass der Ausländer Deutsch dort nicht als wesentliche Verkehrssprache nutzen wird. Die Situation des dortigen Ausbildungs- und Arbeitsmarktes ist bei der Entscheidung zu berücksichtigen.
(5) Eine Verpflichtung oder Zuweisung nach den Absätzen 1 bis 4 ist auf Antrag des Ausländers aufzuheben,
- 1.wenn der Ausländer nachweist, dass in den Fällen einer Verpflichtung oder Zuweisung nach den Absätzen 1 bis 3 an einem anderen Ort, oder im Falle einer Verpflichtung nach Absatz 4 an dem Ort, an dem er seinen Wohnsitz nicht nehmen darf,
- a)ihm oder seinem Ehegatten, eingetragenen Lebenspartner oder einem minderjährigen ledigen Kind, mit dem er verwandt ist und in familiärer Lebensgemeinschaft lebt, eine sozialversicherungspflichtige Beschäftigung im Sinne von Absatz 1 Satz 2, ein den Lebensunterhalt überwiegend sicherndes Einkommen oder ein Ausbildungs- oder Studienplatz zur Verfügung steht,
- b)ihm oder seinem Ehegatten, seinem eingetragenen Lebenspartner oder einem minderjährigen ledigen Kind, mit dem er verwandt ist und in familiärer Lebensgemeinschaft lebt, ein Integrationskurs nach § 43, ein Berufssprachkurs nach § 45a, eine Qualifizierungsmaßnahme von einer Dauer von mindestens drei Monaten, die zu einer Berufsanerkennung führt, oder eine Weiterbildungsmaßnahme nach den §§ 81 und 82 des Dritten Buches Sozialgesetzbuch zeitnah zur Verfügung steht, oder
- c)der Ehegatte, eingetragene Lebenspartner oder ein minderjähriges lediges Kind, mit dem er verwandt ist und mit dem er zuvor in familiärer Lebensgemeinschaft gelebt hat, an einem anderen Wohnort leben,
- 2.zur Vermeidung einer Härte; eine Härte liegt insbesondere vor, wenn
- a)nach Einschätzung des zuständigen Jugendamtes Leistungen und Maßnahmen der Kinder- und Jugendhilfe nach dem Achten Buch Sozialgesetzbuch mit Ortsbezug beeinträchtigt würden,
- b)aus anderen dringenden persönlichen Gründen die Übernahme durch ein anderes Land zugesagt wurde oder
- c)für den Betroffenen aus sonstigen Gründen vergleichbare unzumutbare Einschränkungen entstehen. Fallen die Aufhebungsgründe nach Satz 1 Nummer 1 Buchstabe a innerhalb von drei Monaten ab Bekanntgabe der Aufhebung weg, wirkt die Verpflichtung zur Wohnsitznahme nach Absatz 1 Satz 1 in dem Land fort, in das der Ausländer seinen Wohnsitz verlegt hat. Im Fall einer Aufhebung nach Satz 1 Nummer 2 ist dem Ausländer, längstens bis zum Ablauf der nach Absatz 1 geltenden Frist, eine Verpflichtung nach Absatz 3 oder 4 aufzuerlegen, die seinem Interesse Rechnung trägt.
(6) Bei einem Familiennachzug zu einem Ausländer, der einer Verpflichtung oder Zuweisung nach den Absätzen 1 bis 4 unterliegt, gilt die Verpflichtung oder Zuweisung längstens bis zum Ablauf der nach Absatz 1 für den Ausländer geltenden Frist auch für den nachziehenden Familienangehörigen, soweit die zuständige Behörde nichts anderes angeordnet hat. Absatz 5 gilt für die nachziehenden Familienangehörigen entsprechend.
(7) Die Absätze 1 bis 6 gelten nicht für Ausländer, deren Anerkennung oder erstmalige Erteilung der Aufenthaltserlaubnis im Sinne des Absatzes 1 vor dem 1. Januar 2016 erfolgte.
(8) Widerspruch und Klage gegen Verpflichtungen nach den Absätzen 2 bis 4 haben keine aufschiebende Wirkung.
(9) Die Länder können im Hinblick auf Ausländer, die der Verpflichtung nach Absatz 1 unterliegen, hinsichtlich Organisation, Verfahren und angemessenen Wohnraums durch Rechtsverordnung der Landesregierung oder andere landesrechtliche Regelungen Näheres bestimmen zu
- 1.der Verteilung innerhalb des Landes nach Absatz 2,
- 2.dem Verfahren für Zuweisungen und Verpflichtungen nach den Absätzen 2 bis 4,
- 3.den Anforderungen an den angemessenen Wohnraum im Sinne der Absätze 2, 3 Nummer 1 und von Absatz 5 Satz 1 Nummer 1 Buchstabe a sowie der Form seines Nachweises,
- 4.der Art und Weise des Belegs einer sozialversicherungspflichtigen Beschäftigung nach Absatz 1 Satz 2, eines den Lebensunterhalt sichernden Einkommens sowie eines Ausbildungs- oder Studienplatzes im Sinne der Absätze 1 und 5 Satz 1 Nummer 1 Buchstabe a,
- 5.der Verpflichtung zur Aufnahme durch die zum Wohnort bestimmte Gemeinde und zu dem Aufnahmeverfahren.
(10) § 12 Absatz 2 Satz 2 bleibt für wohnsitzbeschränkende Auflagen in besonders begründeten Einzelfällen unberührt.
