Who receives a residence permit for temporary protection?
The Council of the European Union sometimes decides: certain people receive temporary protection. The basis for this is Directive 2001/55/EC of the European Union. If you have been granted temporary protection in this way, the following applies. You must have declared that you are willing to be admitted into the federal territory. If both apply, the authority must grant you a residence permit. This is a legal entitlement. It is not at the authority's discretion. How long the residence permit is valid is determined by Articles 4 and 6 of Directive 2001/55/EC. These articles set out the duration of temporary protection.
When do you not receive this protection?
There is a ground for exclusion. It is set out in Section 60(8) of the Residence Act. If the requirements of Section 60(8) apply to you, temporary protection is excluded for you. The authority must then refuse the residence permit. This is mandatory for the authority.
How are you distributed among the federal states?
The Federal Office for Migration and Refugees distributes you and other affected persons among the federal states. The federal states can agree quotas among themselves for admission and distribution. A quota determines how many people a state admits. As long as the states have not agreed on their own different distribution key, another key applies. This is the key that is also set for the distribution of people in the asylum procedure.
Who decides which place you go to?
The highest authority of the state to which you were assigned after distribution can issue an allocation decision. This authority can also transfer this task to another body. That body can then decide itself. The state governments may regulate by statutory order how distribution within the state works. The state governments may also transfer this task to other bodies by statutory order. Section 50(4) of the Asylum Act applies accordingly to this procedure. You cannot file an objection against an allocation decision. This is excluded. If you file a lawsuit against the allocation decision, the lawsuit has no suspensive effect. This means: The allocation decision continues to apply despite the lawsuit. The allocation decision expires as soon as you have been granted a residence permit under paragraph 1.
Where must you live?
You have no right to stay in a particular state or at a particular place. You must take up residence and your habitual residence at the place to which you were assigned. This is mandatory for you.
Will you be informed about your rights and obligations?
Yes. The authority informs you in writing. This information must be in a language that you understand. The information covers the rights and obligations associated with temporary protection.
