§ 16b Residence Act: Residence Permit for Studies
This text explains § 16b of the Residence Act (Aufenthaltsgesetz, AufenthG). It is about the residence permit for studying in Germany.
When do you get a residence permit for a full-time degree program?
You are enrolled in a full-time degree program. The degree program is at a state higher education institution. Or at a state-recognized higher education institution. Or at a comparable educational institution.
The educational institution has admitted you.
Then you have a legal entitlement to a residence permit. The authority MUST grant you the residence permit. This is not a discretionary decision.
What else belongs to the residence purpose "studies"?
The residence purpose "studies" also includes:
- study-preparatory measures
- a mandatory internship that is part of your degree program
Study-preparatory measures are:
- Attending a study-preparatory language course. This applies only if you have already been admitted to a full-time degree program and the admission is conditional on attending this language course.
- Attending a Studienkolleg (preparatory college) or a comparable institution. This applies if you can prove that you have been accepted there.
Do you have to prove your language skills?
For your degree program you need certain skills in the language of instruction. The authority requires proof of this only in one case: these language skills were neither checked at your admission, nor are they meant to be acquired through your study-preparatory measure.
How long is the residence permit valid?
For the first grant and for the extension, the following normally applies: the residence permit is valid for two years. It should not fall short of a minimum duration of one year. In exceptional cases this can be different.
It is valid for at least two years if one of these conditions applies:
- You are taking part in a European Union program or a multilateral program with mobility measures.
- An agreement between two or more higher education institutions applies to you.
If your degree program lasts less than two years, you receive the residence permit only for the duration of your degree program.
Is the residence permit extended?
Yes. The residence permit is extended if both conditions apply:
- You have not yet achieved the residence purpose.
- You can still achieve the residence purpose within a reasonable period.
The authority may question your educational institution about this.
How much are you allowed to work during your studies?
Your residence permit permits you a total of employment of up to 140 working days per year. This is called the working-days account (Arbeitstagekonto).
Student side jobs (studentische Nebentätigkeiten) do not count towards these 140 working days.
For part-time employment, the authority calculates the working days in whichever way is most favorable for you. There are two options for this:
- Per day: Each day with up to four hours of work counts as half a working day. Each day with more working hours counts as a full working day.
- Per calendar week: A whole calendar week counts as two and a half working days. This applies during lecture periods if you work up to 20 hours in that week. This applies outside lecture periods regardless of how your working time is distributed.
The authority checks separately for each calendar week which of the two options is more favorable for you.
For which employment does this residence permit not apply?
During your stay for studies (paragraph 1), you must not be granted a residence permit for employment under § 19c paragraph 1 in conjunction with a provision of the Employment Ordinance (Beschäftigungsverordnung) for temporary employment. This is prohibited.
§ 9 does not apply to you during this time.
When can you get a residence permit without the authority being required to grant it?
In the following cases you can get a residence permit. The authority then decides on a case-by-case basis. This is not a legal entitlement.
- A state higher education institution, a state-recognized higher education institution, or a comparable educational institution has admitted you, in one of these three cases: a) You are admitted to a full-time degree program. The admission is tied to a condition. This condition does not concern attending a study-preparatory measure. b) You are admitted to a full-time degree program. The admission is tied to the condition of attending a Studienkolleg (preparatory college) or a comparable institution. However, you cannot provide proof of acceptance there. c) You are admitted to a part-time degree program.
- You have been accepted to take part in a study-preparatory language course. In this case there is no admission to a degree program.
- You have a commitment from a company for a study-preparatory internship.
In the case of number 1, paragraph 1 sentences 2 to 4 and paragraphs 2 to 4 also apply to you.
In the cases of number 2 and number 3, paragraphs 2 to 4 also apply to you. In the case of number 3, the residence permit also entitles you to do the internship.
What happens if your residence permit is to be withdrawn or shortened?
If your residence permit under paragraph 1 or paragraph 5 is to be withdrawn, revoked, or subsequently shortened in accordance with § 7 paragraph 2 sentence 2 — and the reasons for this do NOT lie with you yourself —, then the authority MUST first give you an opportunity: you get up to nine months' time to apply for admission at another educational institution.
What applies if you are already a beneficiary of international protection in another EU state?
Are you a beneficiary of international protection in another member state of the European Union? Then you normally get a residence permit for studies if both conditions apply:
- You have pursued a degree program in that other EU member state for at least two years.
- The requirements of § 16c paragraph 1 sentence 1 numbers 2 and 3 are met.
In exceptional cases this can be different.
The residence permit is valid only for the duration of the part of the degree program that you complete in Germany.
Paragraph 3 on the working-days account also applies to you here.
§ 9 does not apply to you in this case.
Note on the legal basis
Paragraphs 1 to 4 and 6 of this section implement a European Union directive: Directive (EU) 2016/801 of 11 May 2016. This directive governs the entry and residence of third-country nationals for the purposes of research or studies, training, voluntary service, pupil exchange schemes or educational projects, and au pairing.
L132 vom 21.5.2016, S. 21).
