§ 19c AufenthG: Other Employment Purposes; Civil Servants

This section describes four different paths to a residence permit. One path applies to civil servants.
Path 1: Residence permit through a regulation or an agreement
For some jobs, there is a special rule. This rule is set out in the Employment Regulation (Beschäftigungsverordnung). Or it is set out in an intergovernmental agreement. This is an agreement between Germany and another country. Does such a rule state that you can be admitted for this job? Then you can get a residence permit for it. The authority decides on your application. It does not matter whether you have a qualification as a skilled worker.
Path 2: Residence permit through practical professional experience
Do you have extensive practical professional knowledge? This means: You have a lot of practical experience in your profession. Does the Employment Regulation state that you can be admitted for a qualified job? Then you can get a residence permit for it. The authority decides on your application.
Path 3: Residence permit in a justified individual case
Is there a public interest in your job? This can especially be a regional interest. It can also be an economic interest. It can also be a labour-market-policy interest. Then you can get a residence permit in a justified individual case. The authority decides on your application.
Path 4: Residence permit for civil servants
Are you in a civil service relationship (Beamtenverhältnis) with a German public employer? A public employer (Dienstherr) is the body you work for as a civil servant. Then you have a legal entitlement to a residence permit. The authority must grant you this residence permit. This residence permit is meant for you to fulfil your official duties in Germany. The Federal Employment Agency does not need to approve this.
The residence permit is valid for three years. This applies if your service relationship is not limited to a shorter period. Is your service relationship limited to a shorter period? Then this shorter period applies to your residence permit.
After three years, you have a legal entitlement to a settlement permit. The authority must grant you this settlement permit. Two conditions from Section 9(2) sentence 1 of the Residence Act do not apply to this settlement permit. These are the conditions in number 1 and number 3.
(1) Einem Ausländer kann unabhängig von einer Qualifikation als Fachkraft eine Aufenthaltserlaubnis zur Ausübung einer Beschäftigung erteilt werden, wenn die Beschäftigungsverordnung oder eine zwischenstaatliche Vereinbarung bestimmt, dass der Ausländer zur Ausübung dieser Beschäftigung zugelassen werden kann.
(2) Einem Ausländer mit ausgeprägten berufspraktischen Kenntnissen kann eine Aufenthaltserlaubnis zur Ausübung einer qualifizierten Beschäftigung erteilt werden, wenn die Beschäftigungsverordnung bestimmt, dass der Ausländer zur Ausübung dieser Beschäftigung zugelassen werden kann.
(3) Einem Ausländer kann im begründeten Einzelfall eine Aufenthaltserlaubnis erteilt werden, wenn an seiner Beschäftigung ein öffentliches, insbesondere ein regionales, wirtschaftliches oder arbeitsmarktpolitisches Interesse besteht.
(4) Einem Ausländer, der in einem Beamtenverhältnis zu einem deutschen Dienstherrn steht, wird ohne Zustimmung der Bundesagentur für Arbeit eine Aufenthaltserlaubnis zur Erfüllung seiner Dienstpflichten im Bundesgebiet erteilt. Die Aufenthaltserlaubnis wird für die Dauer von drei Jahren erteilt, wenn das Dienstverhältnis nicht auf einen kürzeren Zeitraum befristet ist. Nach drei Jahren wird eine Niederlassungserlaubnis abweichend von § 9 Absatz 2 Satz 1 Nummer 1 und 3 erteilt.
