§ 9 AufenthG: Settlement Permit
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
What is the settlement permit?
The settlement permit is a residence title without a time limit. This means: it has no expiry date. The authority may only attach an ancillary provision to it if the law expressly allows this. An ancillary provision is an additional condition. Note: § 47 of the Residence Act remains unaffected by this.
When do you have a legal entitlement to the settlement permit?
Do you meet ALL of the following conditions? Then the authority must grant you the settlement permit. This is then not at the authority's discretion. You then have a legal entitlement to it.
You must meet all of these conditions:
- You have held a residence permit for five years.
- Your living costs are covered. This means: you can support yourself.
- You have paid at least 60 months of mandatory contributions or voluntary contributions into the statutory pension insurance. Alternatively, you can show comparable entitlements with an insurance or provident institution. Periods lost due to childcare or home care are counted towards this.
- Reasons of public safety or public order must not stand in the way. The authority examines: how serious and what kind of violation it was, how great the danger from you is, how long you have already lived in the federal territory, and what ties you have in the federal territory.
- Are you an employee? Then you must be allowed to work.
- You hold the other permits that you need for permanent employment.
- You have sufficient knowledge of the German language.
- You have basic knowledge of the legal and social order and of living conditions in the federal territory.
- You have adequate housing. This applies to you and to your family members who live with you in a shared household.
Exceptions to conditions 7 and 8
Have you successfully completed an integration course? Then conditions 7 (German language skills) and 8 (basic knowledge) are considered proven.
Are you unable to meet conditions 7 and 8 because of a physical, mental, or psychological illness or disability? Then they do not apply to you.
The authority may also waive conditions 7 and 8 in cases of hardship. This is a discretionary decision by the authority, not a legal entitlement of yours. A case of hardship means: the condition would affect you especially hard.
Conditions 7 and 8 also do not apply if both of the following apply:
- You can communicate verbally in simple German, and
- under § 44 paragraph 3 number 2 you had no entitlement to take part in the integration course, or under § 44a paragraph 2 number 3 you were not obliged to take part.
Exception to conditions 2 and 3
Are you unable to meet conditions 2 (secure living costs) and 3 (pension insurance contributions) because of a physical, mental, or psychological illness or disability? Then these conditions also do not apply to you.
Special rule for married couples
Do you live together as a married couple in a marital union? Then it is enough if only one of you meets conditions 3, 5, and 6.
Are you in a course of education or training that leads to a recognized school or vocational qualification or to a university degree? Then condition 3 (pension insurance contributions) does not apply to you.
Note: This rule also applies accordingly in the cases under § 26 paragraph 4.
Special rule for spouses of holders of a settlement permit under § 18c
Does your spouse hold a settlement permit under § 18c? Then you have a legal entitlement to your own settlement permit if you meet ALL of the following conditions:
- You live with your spouse in a marital union.
- You have held a residence permit for three years.
- You are in employment, working at least 20 hours per week.
- Conditions 2 and 4 to 9 (see above) apply to you.
Note: The rules mentioned above on integration courses, illness or disability, and cases of hardship apply here accordingly.
This special rule does not exclude the other option. You can still also obtain the settlement permit through the normal married-couple rule.
Which periods are counted?
For calculating your required period of holding a residence permit, the following periods are counted:
- Did you previously hold a residence permit or a settlement permit? Did you hold a settlement permit when you left the country? Then this earlier period is counted. Periods spent outside the federal territory in between are deducted if they led to the settlement permit lapsing. In total, a maximum of four years is counted.
- For each period outside the federal territory that did not lead to your residence permit lapsing, a maximum of six months is counted.
- Periods of lawful residence in the federal territory for the purpose of study or vocational training are counted at half their length.
