§ 19d Residence permit for skilled holders of toleration status (Duldung) for the purpose of employment
What is this about?
You have a toleration status (Duldung). This means: your deportation is currently suspended. You have a professional qualification. Under certain conditions, you can get a residence permit. This residence permit applies to employment that matches your professional qualification.
When do you normally get a residence permit?
Do you meet all of the following conditions? Then you shall generally get a residence permit. In exceptional cases, the authority can decide otherwise.
1. You meet one of the following three qualifications
Option A: You have completed a qualified vocational training program in Germany. This training must be state-recognized or regulated in a comparable way. Or: You have completed a state-recognized training program in an auxiliary care occupation (Pflegehilfstätigkeit). This training must be regulated under federal or state law. Or: You have completed a degree program at a university in Germany.
Option B: You have a foreign university degree. This degree must be recognized or comparable to a German university degree. You have been continuously employed for two years in work that matches this degree.
Option C: You have been continuously employed in qualified work for three years. In the last year before your application, you were not permitted to rely on public funds for your own living costs or the living costs of your family members or other household members. Exception: benefits for accommodation and heating do not count as public funds here.
2. In addition, you must meet all of the following conditions
- You have sufficient housing.
- You have sufficient knowledge of the German language.
- You have not intentionally deceived the foreigners authority (Ausländerbehörde) about circumstances that are important for your stay.
- You have not intentionally delayed or obstructed official measures to end your stay.
- You have no connections to extremist or terrorist organizations. You also do not support such organizations.
- You have not been convicted in Germany of an intentionally committed criminal offense.
Note on the last condition: Fines up to a total of 50 day-fine units generally do not count. Fines up to 90 day-fine units also generally do not count if they concern offenses that only foreigners can commit under the Residence Act (Aufenthaltsgesetz) or the Asylum Act (Asylgesetz).
Special case: You had a toleration status (Duldung) for vocational training
Did you have a toleration status (Duldung) for vocational training under Section 60a(2) sentence 3 in conjunction with Section 60c? Have you successfully completed this vocational training?
Then the authority MUST grant you a residence permit for two years for employment that matches this qualification. This is a legal entitlement. It is not at the authority's discretion.
Condition for this: You meet the conditions on housing and German language skills, as well as the conditions on extremism and criminal offenses from the list above in number 2.
When is this residence permit revoked?
The authority MUST revoke your residence permit from this special case if one of the following points applies:
- The employment relationship on which this residence permit was based ends. This applies only if the reasons for this lie with you personally.
- You have been convicted in Germany of an intentionally committed criminal offense. Here too: fines up to a total of 50 day-fine units, or up to 90 day-fine units for the offenses mentioned above, generally do not count.
What happens after two years of matching work?
Have you worked for two years in employment that matches your professional qualification? Then, after that, you are allowed to carry out any employment with this residence permit.
Exception from other rules possible
The authority may grant you this residence permit even if the rules from Section 5(2) and Section 10(3) sentence 1 speak against it. This is a discretionary rule. The authority decides on a case-by-case basis.
Special case: Residence permit under Chapter 2, Section 5
Do you have a residence permit under Chapter 2, Section 5 that was granted by applying Section 10(3) sentence 1?
Then the law treats your case as if the conditions from paragraph 1 apply. This means: the same rules as above in paragraph 1 also apply to you.
