§ 35 AufenthG: Independent, Unlimited Right of Residence of Children
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
What this section is about
This section applies to foreign nationals who are minors or young adults. These foreign nationals have a residence permit. A residence permit allows you to stay in Germany for a period of time.
This section regulates when you get a settlement permit. A settlement permit allows you to stay in Germany permanently.
When do you have a right to the settlement permit when you turn 16?
Are you a minor? Do you have a residence permit under this section of the law? Have you held this residence permit for five years by the time you turn 16? Then the authority must grant you a settlement permit. This is mandatory. It is not at the authority's discretion. For this legal entitlement, the rules from Section 9 (2) of the law do not apply. Instead, the rules from this section apply.
When do you have a right to the settlement permit as an adult?
You also have a right to the settlement permit if all three of the following conditions apply:
- You are an adult. And you have held the residence permit for five years.
- You have sufficient knowledge of the German language.
- Your livelihood is secure. This means: You can pay for your own living costs. Or: You are in education or training. This education or training must lead to a recognized school-leaving qualification. Or to a recognized vocational qualification. Or to a university degree.
Do you meet all three conditions? Then the authority must grant you a settlement permit. This is mandatory.
Does time at school abroad count toward the five years?
Did you attend school outside Germany? This time normally does not count toward the five years with a residence permit. In exceptional cases, this can be different.
When is there NO right to the settlement permit, even though you meet the conditions?
Do you meet the conditions from the sections above? Even so, you have no right to the settlement permit in the following cases:
- There is an interest in expelling you (Ausweisungsinteresse). This means: There are grounds to expel you from Germany. These grounds are based on your personal conduct.
- You were convicted of an intentional criminal offense within the last three years. Intentional means: You committed the act deliberately. The conviction was for at least six, or for a prison sentence of at least three months. Or for a fine of at least 90 daily rates. The same applies if a court suspended the imposition of a youth sentence.
- Your livelihood is not secure without you using certain benefits. These are benefits under Book Two of the Social Code. Or under Book Twelve of the Social Code. Or youth welfare assistance under Book Eight of the Social Code. An exception applies if you are in education or training. This education or training must lead to a recognized school-leaving or vocational qualification.
Does one of these three cases apply? Then the authority may still grant you a settlement permit. Or it may extend your residence permit. This is a discretionary decision. You have no legal entitlement to it.
In the case of a conviction (case number 2 above), was the youth sentence or prison sentence suspended on probation? Or was the imposition of a youth sentence suspended? Then the authority will normally extend your residence permit until the end of the probation period. In exceptional cases, this can be different.
Exception for illness or disability
Are you unable to meet certain conditions because of a physical, mental, or psychological illness? Or are you unable to meet them because of a disability?
This concerns the following conditions: sufficient knowledge of German, secure livelihood or education/training (from the section on the adult's right above), and secure livelihood without certain benefits (from the section on the grounds for exclusion above).
Are you unable to meet one of these conditions because of illness or disability? Then the authority must waive this condition. This is mandatory.
