Section 36 Residence Act: Reunification of parents and other family members
Subsection 1: Parents of a minor foreign national
Is your child a minor and a foreign national? Does your child have a specific residence permit or settlement permit? Then you, as a parent, may have a right to your own residence permit.
Your child must hold one of these permits:
- a residence permit under Section 23 (4),
- a residence permit under Section 25 (1) or (2) sentence 1,
- a settlement permit under Section 26 (3),
- a settlement permit under Section 26 (4) — but only if your child previously held a residence permit under Section 25 (2) sentence 2.
In addition, this condition must be met: no other parent with custody rights (Sorgerecht) may already be residing in the federal territory.
Are all these requirements met? Then the authority MUST grant you a residence permit. This is a legal entitlement — the authority has no discretion here.
Note: Normally, two additional conditions from the law apply to a residence permit (Section 5 (1) no. 1 and Section 29 (1) sentence 1 no. 2). In this case, these two conditions do not apply.
Subsection 2: Other family members
Are you another family member of a foreign national? Then you may be able to get a residence permit for family reunification, under one condition.
The condition: it must be necessary to avoid exceptional hardship.
The authority decides on a case-by-case basis here. This is not a guaranteed right.
Are you an adult? Then Section 30 (3) and Section 31 also apply to you accordingly. Are you a minor? Then Section 34 also applies to you accordingly.
Subsection 3: Parents of foreign nationals with certain residence titles
This subsection only applies under this condition: your child (the foreign national) received one of these titles for the first time on or after 1 March 2024:
- an EU Blue Card,
- an ICT Card,
- a Mobile ICT Card,
- or a residence title under Section 18a, Section 18b, Section 18c (3), Section 18d, Section 18f or Section 19c (1) — specifically for employment as a senior employee, as a manager, as a company specialist, as a scientist, as a guest scientist, as an engineer or technician in the research team of a guest scientist, or as a teacher,
- or a residence title under Section 19c (2) or (4) sentence 1,
- or a residence title under Section 21.
Does this apply to you? Then you, as a parent, may be able to get a residence permit for family reunification. Here too, the authority decides on a case-by-case basis — this is not a guaranteed right.
This rule also applies to the parents of your child's spouse. Requirement for this: the spouse resides permanently in the federal territory.
Additional condition: you will only receive the residence permit if the requirement under Section 5 (1) no. 1 is met.
