Obligation to Inform When Recruiting from Abroad (§ 45c AufenthG)
If an employer in Germany recruits you from abroad, they must inform you about counseling services.
What must your employer do?
- Your employer must inform you in writing by your first day of work at the latest.
- They must tell you that you have a right to information and counseling (under § 45b).
- They must give you the contact details of the nearest counseling center.
When does this obligation not apply?
This obligation does not apply in the case of cross-border job placement under the Social Code.
Schließt ein Arbeitgeber mit Sitz im Bundesgebiet mit einem Drittstaatsangehörigen mit Wohnsitz oder gewöhnlichem Aufenthalt im Ausland einen Arbeitsvertrag zur Arbeitsleistung im Inland, hat er den Drittstaatsangehörigen spätestens am ersten Tag der Arbeitsleistung in Textform auf die Möglichkeit einer Information oder Beratung nach § 45b Absatz 1 Satz 1 und 2 hinzuweisen. Er hat dabei zumindest die aktuellen Kontaktdaten der vom Arbeitsplatz nächstgelegenen Beratungsstelle anzugeben. Die Hinweispflicht des Arbeitgebers entfällt bei einer grenzüberschreitenden Vermittlung im Sinne des § 299 des Dritten Buches Sozialgesetzbuch.
