§ 62b AufenthG: Departure Custody
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
Ausreisegewahrsam (departure custody) means: the authority can hold you in custody for up to 28 days. The goal is to secure your deportation. Only a court may order this.
Important: this does not require the same conditions as regular detention pending deportation under Section 62(3). In particular, you do not need to be a flight risk.
When can the authority apply for this?
The authority can apply for departure custody. The court then decides on it. This is not an automatic duty — the authority has discretion. For this, all three of the following conditions must be met together:
Your deadline to leave the country has expired. Exception: you were unable to leave through no fault of your own. Or you exceeded the deadline by only a little.
It is established that your deportation can actually be carried out within the 28 days.
Your behavior gives reason to expect that you want to make your deportation more difficult or prevent it.
For condition 3, the following applies: the law automatically presumes this if one of these four cases applies: a) You violated your statutory duties to cooperate. b) You deceived the authorities about your identity or nationality. c) You were convicted of an intentional criminal offense that you committed within Germany. Fines totaling up to 50 day-fine units (the German "Tagessatz" system) do not count here. d) You exceeded the deadline to leave the country by more than 30 days.
When may the authority NOT apply for this?
The court must refrain from ordering departure custody if you credibly show that you do not intend to evade deportation. The same applies if this is obvious. This is a duty, not a matter of discretion.
Where will you be held?
Departure custody takes place in the transit area of an airport. Or it takes place in accommodation from which your departure is possible.
What else applies?
Section 62(1) and (4a), as well as Section 62a, also apply accordingly to departure custody.
The time spent in departure custody must be counted toward the total duration of any later detention pending deportation. This is a duty: it is therefore not added on top, but deducted from any later detention pending deportation.
Being held without a judge — only provisional
The authority responsible for the application can also hold you without a prior court decision. This is possible if all three of the following conditions are met together:
There is an urgent suspicion that the conditions from subsection 1, sentence 1 (see above) apply to you.
The court's decision on departure custody cannot be obtained beforehand.
There is a well-founded suspicion that you want to evade this order.
If the authority holds you in this way, it must bring you before a judge without undue delay. Without undue delay means: without delay, as quickly as possible. The judge then decides on the order for departure custody.
