Restrictions on legal remedies
Non-appealable decisions
The following decisions cannot be appealed:
- The refusal of a national visa at the border
- The refusal of a passport substitute at the border
If a visa is refused, you will be informed about the possibility of submitting an application at the responsible diplomatic mission.
No objection possible
There is no objection (Widerspruch) against the following decisions:
- The refusal of the suspension of deportation (toleration status / Duldung)
- The ordering and time-limiting of an entry and residence ban by the BAMF
(1) Die Versagung eines nationalen Visums und eines Passersatzes an der Grenze sind unanfechtbar. Der Ausländer wird bei der Versagung eines nationalen Visums und eines Passersatzes an der Grenze auf die Möglichkeit einer Antragstellung bei der zuständigen Auslandsvertretung hingewiesen.
(2) Gegen die Versagung der Aussetzung der Abschiebung findet kein Widerspruch statt.
(3) Gegen die Anordnung und Befristung eines Einreise- und Aufenthaltsverbots durch das Bundesamt für Migration und Flüchtlinge findet kein Widerspruch statt.
