Penalty: Facilitating Entry in Violation of Re-entry Ban
Anyone who facilitates the entry or transit of a foreign national subject to a re-entry ban: This is punishable with imprisonment from 3 months to 5 years.
The attempt is also punishable.
Anyone who does this on a commercial basis or as a member of a gang: The penalty is imprisonment of not less than 1 year.
(1) Mit Freiheitsstrafe von drei Monaten bis zu fünf Jahren wird bestraft, wer entgegen § 14 Absatz 3 Satz 1 einem dort genannten Ausländer die Einreise in oder die Durchreise durch das Bundesgebiet ermöglicht.
(2) Der Versuch ist strafbar.
(3) Mit Freiheitsstrafe nicht unter einem Jahr wird bestraft, wer in den Fällen des Absatzes 1 gewerbsmäßig oder als Mitglied einer Bande handelt, die sich zur fortgesetzten Begehung solcher Taten verbunden hat.
