§ 12b StAG: Crediting of Residence Periods
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This rule explains how your periods of residence in Germany are counted for naturalization, if you were abroad for a while in between.
Were you abroad for up to six months? Then your habitual residence in Germany is not interrupted by this. It simply continues to count.
Were you abroad for longer than six months? Then your habitual residence still continues to exist. Condition: You re-enter within the deadline set for you by the immigration authority (Ausländerbehörde).
Did you only exceed this deadline because you must complete your statutory military service in your home country? Then the same applies as above. Condition: You re-enter within three months after the end of your military service or alternative civilian service.
Are you a national of another EU country or an EEA country? Then the three rules above do not apply to you. Instead, § 4a paragraph 6 of the Freedom of Movement Act/EU (Freizügigkeitsgesetz/EU) applies to you. The same applies to your family members. It also applies to persons who are close to you and who have a right of residence under § 3a of the Freedom of Movement Act/EU. It also applies to persons with a right of residence under Union law under § 12a of the Freedom of Movement Act/EU. And it applies to persons with a right of residence under § 16 of the Freedom of Movement Act/EU.
There is also a limit that applies to all the cases above. Were your periods abroad, added together, longer than half of the period of residence that you actually need? This required period of residence depends on your case. Sometimes it is the period under § 4 paragraph 3 sentence 1 number 1. Sometimes it is the period needed for naturalization. If your periods abroad exceed this half, then your habitual residence generally no longer continues to exist. This means: normally your residence then no longer counts. Only in exceptional cases can it be different. This limit also applies even if the rules above would say something different.
Were you abroad for longer than six months, and none of the exceptions above apply to you? Then the authority can still credit your earlier period of residence in Germany. This can be up to three years. This is not an obligation for the authority. The authority decides on a case-by-case basis. The same rule applies if your residence no longer continues to exist because of the limit above.
Sometimes your residence is unlawful for a certain period. This can happen, for example, if you did not apply for your residence title in time — that means the first grant or the extension. In this case, this interruption does not count against you. It is not taken into account.
Is your residence temporarily unlawful for another reason? Then the same rule applies as for crediting earlier periods of residence: the authority can credit this time, up to three years. This is also not an obligation — the authority decides on a case-by-case basis.
