Transitional Provision for Toleration for Persons with Unclear Identity (§ 105 AufenthG)
When is the toleration with the note "unclear identity" issued?
The immigration authority decides on this note at the earliest when it extends your toleration or issues it for a different reason.
Exceptions
The rules for toleration for persons with unclear identity (§ 60b) do not apply to you if:
- you were in an apprenticeship or employment until July 1, 2020,
- you have or have applied for a training toleration or employment toleration and meet the requirements.
(1) Die Ausländerbehörde entscheidet bei geduldeten Ausländern über die Ausstellung einer Bescheinigung über die Duldung nach § 60a Absatz 4 mit dem Zusatz „für Personen mit ungeklärter Identität” frühestens aus Anlass der Prüfung einer Verlängerung der Duldung oder der Erteilung der Duldung aus einem anderen Grund.
(2) Auf geduldete Ausländer findet § 60b bis zum 1. Juli 2020 keine Anwendung, wenn sie sich in einem Ausbildungs- oder Beschäftigungsverhältnis befinden.
(3) Ist ein Ausländer Inhaber einer Ausbildungsduldung oder einer Beschäftigungsduldung oder hat er diese beantragt und erfüllt er die Voraussetzungen für ihre Erteilung, findet § 60b keine Anwendung.
