Administrative Procedure (§ 105a AufenthG)
The Residence Act contains many rules on administrative procedure. This means: how an authority works and which data it collects and passes on.
No state law can deviate from these rules. They therefore apply in the same way in every federal state (Bundesland).
These include the rules on:
- residence titles, identity documents and forms (§ 4, § 78, § 78a, § 79, § 81)
- distribution and place of residence (§ 15a, § 23, § 23a, § 61)
- integration courses (§ 43, § 44a)
- involvement of other bodies (§ 72, § 73)
- duties to cooperate and to provide information (§ 82)
- data: collection, transfer and deletion (§ 87, § 89, § 90, § 90a, § 90b, § 91, § 91c)
- federal statutory instruments (§ 99, § 104a)
There are two exceptions: § 78 para. 1 sentence 8 and § 99 para. 1 no. 3a.
