§ 104c Transitional Provision on the Opportunity Residence Right

The residence permit under the Chancen-Aufenthaltsrecht (the opportunity residence law) is legally deemed a humanitarian residence title. It may only be extended as a residence permit under § 25a (well-integrated young people) or § 25b (sustainable integration).
An application for a different residence title may be submitted. However, it does not have the legal effect of a Fiktionsbescheinigung (a certificate confirming that your current residence status continues while your application is being processed).
(1) Eine Aufenthaltserlaubnis nach § 104c in der Fassung dieses Gesetzes vom 31. Dezember 2022 gilt bis zum Ende ihrer Geltungsdauer als Aufenthaltstitel nach Kapitel 2 Abschnitt 5.
(2) Die Aufenthaltserlaubnis nach § 104c in der Fassung dieses Gesetzes vom 31. Dezember 2022 kann nur als Aufenthaltserlaubnis nach § 25a oder § 25b verlängert werden. Sie gilt als Aufenthaltstitel nach Kapitel 2 Abschnitt 5. Der Antrag auf Erteilung eines anderen Aufenthaltstitels als nach § 25a oder § 25b entfaltet nicht die Wirkung nach § 81 Absatz 4.
