Language courses and school attendance
Language course or school exchange
You want to take part in a language course. The language course does not prepare you for university studies. Then you can get a residence permit for this. The authority decides on your application. There is no guarantee.
You want to take part in a school exchange. You can also get a residence permit for this. The authority decides on your application. Here too, there is no guarantee.
You can also get this residence permit for a school exchange if there is no direct exchange taking place.
School attendance
You want to attend a school in Germany. The authority should grant you a residence permit for this from the ninth grade level onward. As a rule, you receive it — only in special exceptional cases is it different.
Several conditions must be met at the same time for this.
The school class must be made up of students of different nationalities.
In addition, one of the following two conditions must apply:
The school is a public school or a state-recognized school with an international orientation.
The school is not financed, or not predominantly financed, from public funds. And: The school prepares students for international qualifications, or for qualifications of other states, or for state-recognized qualifications.
Restrictions during your stay
You have a residence permit for school attendance, as described above. The authority should not grant you a residence permit for another purpose of stay during this time, as a rule. There is only an exception if you have a legal entitlement to it. In special exceptional cases, it can still be different.
You had a residence permit for a school exchange. Directly afterward, you may only get a residence permit for another purpose if you have a legal entitlement to it. Without such an entitlement, this is prohibited.
A specific section of this law (Section 9) does not apply in this case.
The residence permit for the language course gives you a right to work. You may work up to 20 hours per week. More is not allowed.
The residence permit for the school exchange gives you no right to employment. This means: You may not work with it.
The residence permit for school attendance also gives you no right to employment. This means: You may not work with it either.
Agreements of the federal states
Some federal states have made agreements with public authorities in another state. These agreements concern the attendance of domestic schools by foreign students. Such agreements remain valid and are not changed by this rule.
Based on such agreements, a residence permit for participation in school attendance may be granted. The authority decides on a case-by-case basis. However, this is only possible if the highest state authority responsible for residence law has agreed to the agreement.
(1) Einem Ausländer kann eine Aufenthaltserlaubnis zur Teilnahme an Sprachkursen, die nicht der Studienvorbereitung dienen, oder zur Teilnahme an einem Schüleraustausch erteilt werden. Eine Aufenthaltserlaubnis zur Teilnahme an einem Schüleraustausch kann auch erteilt werden, wenn kein unmittelbarer Austausch erfolgt.
(2) Einem Ausländer soll eine Aufenthaltserlaubnis zum Zweck des Schulbesuchs in der Regel ab der neunten Klassenstufe erteilt werden, wenn in der Schulklasse eine Zusammensetzung aus Schülern verschiedener Staatsangehörigkeiten gewährleistet ist und es sich handelt
- 1.um eine öffentliche oder staatlich anerkannte Schule mit internationaler Ausrichtung oder
- 2.um eine Schule, die nicht oder nicht überwiegend aus öffentlichen Mitteln finanziert wird und die Schüler auf internationale Abschlüsse, Abschlüsse anderer Staaten oder staatlich anerkannte Abschlüsse vorbereitet.
(3) Während eines Aufenthalts zum Schulbesuch nach Absatz 2 soll in der Regel eine Aufenthaltserlaubnis zu einem anderen Aufenthaltszweck nur in Fällen eines gesetzlichen Anspruchs erteilt werden. Im Anschluss an einen Aufenthalt zur Teilnahme an einem Schüleraustausch darf eine Aufenthaltserlaubnis für einen anderen Zweck nur in den Fällen eines gesetzlichen Anspruchs erteilt werden. § 9 findet keine Anwendung. Die Aufenthaltserlaubnis nach Absatz 1 zur Teilnahme an einem Sprachkurs berechtigt nur zur Ausübung einer Beschäftigung von bis zu 20 Stunden je Woche. Die Aufenthaltserlaubnis nach Absatz 1 zur Teilnahme an einem Schüleraustausch und die Aufenthaltserlaubnis nach Absatz 2 berechtigen nicht zur Ausübung einer Erwerbstätigkeit.
(4) Bilaterale oder multilaterale Vereinbarungen der Länder mit öffentlichen Stellen in einem anderen Staat über den Besuch inländischer Schulen durch ausländische Schüler bleiben unberührt. Aufenthaltserlaubnisse zur Teilnahme am Schulbesuch können auf Grund solcher Vereinbarungen nur erteilt werden, wenn die für das Aufenthaltsrecht zuständige oberste Landesbehörde der Vereinbarung zugestimmt hat.
