This section explains the principles of skilled-worker immigration to Germany.
Germany allows foreign skilled workers and workers into the country when this is good for Germany's economy and science. The authority also looks at the situation on the labour market.
There are special options for foreign skilled workers and workers. These options should, as a rule, ensure that there are enough skilled workers and workers in Germany. They should, as a rule, also strengthen the social security systems in Germany.
The law also wants skilled workers and workers with a lot of professional experience to become permanently integrated into the labour market and into society. In doing so, the state also pays attention to public security.
What requirements apply to a residence title for employment?
For a residence title with which you may work, you need the following:
First: You need a concrete job offer.
Second: The Federal Employment Agency must approve (this is regulated by Section 39). There is an exception: sometimes approval is not necessary. This is then determined by a law, an intergovernmental agreement, or the Employment Ordinance. But even then, the authority may refuse your residence title, at its discretion, if one of the reasons in Section 40 (2) or (3) applies. The authority decides this on a case-by-case basis.
Third: Does your profession require a special permit to practise it (a professional practice permit)? Then you must already have this permit, or the permit must already have been promised to you.
Fourth: Is your qualification a requirement for your residence title? Then the following applies: either it has been established that your qualification is equivalent to a German qualification. Or you have a recognised foreign university degree. Or you have a foreign university degree that is comparable to a German university degree.
Fifth: You and your employer must assure that the work should, as a rule, really be carried out.
Sixth, only if you are older than 45: Are you receiving a residence title under Section 18a or Section 18b for the first time, and have you already turned 45? Then your salary must be at least 55 percent of the annual contribution assessment ceiling in the general pension insurance. Exception: you can prove that you have made adequate provision for your age (adequate retirement provision). Then this salary threshold does not apply to you.
The authority may also make an exception to these six requirements, at its discretion. This is possible if there is a public interest in your employment. This can, for example, be a regional, economic, or labour-market-policy interest. This applies especially if you only narrowly miss the salary threshold or only slightly exceed the age limit. Here too, the authority decides on a case-by-case basis.
The Federal Ministry of the Interior, Building and Community sets the exact minimum salary anew every year. It announces this amount in the Federal Gazette (Bundesanzeiger) by 31 December of the previous year at the latest.
What is a skilled worker?
The law distinguishes between two types of skilled workers.
The first type: You have a qualified vocational training from Germany. Or you have a foreign vocational qualification that is equivalent to a German qualified vocational training. Then you are a skilled worker with vocational training.
The second type: You have a German university degree. Or you have a recognised foreign university degree. Or you have a foreign university degree that is comparable to a German university degree. Then you are a skilled worker with academic training.
How long is your residence title valid?
This rule applies to residence titles under Section 18a, Section 18b, Section 18g and Section 19c.
Normally, you receive your residence title for four years.
There is an exception: Is your employment relationship fixed for a shorter period? Or did the Federal Employment Agency approve only for a shorter period? Then your residence title is valid for this shorter period plus an additional three months.
However, your residence title is never valid for longer than four years.
(1) Die Zulassung ausländischer Beschäftigter orientiert sich an den Erfordernissen des Wirtschafts- und Wissenschaftsstandortes Deutschland unter Berücksichtigung der Verhältnisse auf dem Arbeitsmarkt. Die besonderen Möglichkeiten für ausländische Fach- und Arbeitskräfte dienen der Sicherung der Fach- und Arbeitskräftebasis und der Stärkung der sozialen Sicherungssysteme. Sie sind ausgerichtet auf die nachhaltige Integration von Fachkräften sowie Arbeitskräften mit ausgeprägter Berufserfahrung in den Arbeitsmarkt und die Gesellschaft unter Beachtung der Interessen der öffentlichen Sicherheit.
(2) Die Erteilung eines Aufenthaltstitels zur Ausübung einer Beschäftigung nach diesem Abschnitt setzt voraus, dass
- 1.ein konkretes Arbeitsplatzangebot vorliegt,
- 2.die Bundesagentur für Arbeit nach § 39 zugestimmt hat; dies gilt nicht, wenn durch Gesetz, zwischenstaatliche Vereinbarung oder durch die Beschäftigungsverordnung bestimmt ist, dass die Ausübung der Beschäftigung ohne Zustimmung der Bundesagentur für Arbeit zulässig ist; in diesem Fall kann die Erteilung des Aufenthaltstitels auch versagt werden, wenn einer der Tatbestände des § 40 Absatz 2 oder 3 vorliegt,
- 3.eine Berufsausübungserlaubnis erteilt wurde oder zugesagt ist, soweit diese erforderlich ist,
- 4.die Gleichwertigkeit der Qualifikation festgestellt wurde oder ein anerkannter ausländischer oder ein einem deutschen Hochschulabschluss vergleichbarer ausländischer Hochschulabschluss vorliegt, soweit dies eine Voraussetzung für die Erteilung des Aufenthaltstitels ist,
4a. der Ausländer und der Arbeitgeber versichern, dass die Beschäftigung tatsächlich ausgeübt werden soll, und
- 5.in den Fällen der erstmaligen Erteilung eines Aufenthaltstitels nach § 18a oder § 18b nach Vollendung des 45. Lebensjahres des Ausländers die Höhe des Gehalts mindestens 55 Prozent der jährlichen Beitragsbemessungsgrenze in der allgemeinen Rentenversicherung entspricht, es sei denn, der Ausländer kann den Nachweis über eine angemessene Altersversorgung erbringen. Von den Voraussetzungen nach Satz 1 kann abgesehen werden, wenn ein öffentliches, insbesondere ein regionales, wirtschaftliches oder arbeitsmarktpolitisches Interesse an der Beschäftigung des Ausländers besteht, insbesondere, wenn die Gehaltsschwelle nur geringfügig unterschritten oder die Altersgrenze nur geringfügig überschritten wird. Das Bundesministerium des Innern, für Bau und Heimat gibt das Mindestgehalt für jedes Kalenderjahr jeweils bis zum 31. Dezember des Vorjahres im Bundesanzeiger bekannt.
(3) Fachkraft im Sinne dieses Gesetzes ist ein Ausländer, der
- 1.eine inländische qualifizierte Berufsausbildung oder eine mit einer inländischen qualifizierten Berufsausbildung gleichwertige ausländische Berufsqualifikation besitzt (Fachkraft mit Berufsausbildung) oder
- 2.einen deutschen, einen anerkannten ausländischen oder einen einem deutschen Hochschulabschluss vergleichbaren ausländischen Hochschulabschluss besitzt (Fachkraft mit akademischer Ausbildung).
(4) Aufenthaltstitel gemäß den §§ 18a, 18b, 18g und 19c werden für die Dauer von vier Jahren oder, wenn das Arbeitsverhältnis oder die Zustimmung der Bundesagentur für Arbeit auf einen kürzeren Zeitraum befristet sind, für diesen kürzeren Zeitraum zuzüglich dreier Monate, nicht jedoch für länger als vier Jahre, erteilt.
