§ 17 AufenthG: Search for a Training Place or Study Place

Residence permit for looking for a training place
You are looking for a place for a qualified vocational training program in Germany. The immigration authority can give you a residence permit for this. This is a discretionary decision. The authority decides on your individual case. It is not a guaranteed legal entitlement.
You only get this residence permit if all of the following conditions are met.
- You are not yet 35 years old.
- Your living costs are covered. This means: You can pay for your own living costs, without state help.
- You have a qualification from a German school abroad. Or you have a school-leaving qualification that gives you access to higher education — either in Germany or in the country where you got the qualification.
- You have sufficient German language skills.
The authority gives you the residence permit for up to nine months.
You can only get this residence permit again if, after you leave the country, you stayed abroad for at least as long as you had previously stayed in Germany with this permit.
Residence permit for applying for a place to study
You want to apply for a place to study. The immigration authority can give you a residence permit for this. This, too, is a discretionary decision.
You only get this residence permit if these conditions are met.
- You already have the school and language requirements for a course of study. Or you want to acquire these requirements during your stay.
- Your living costs are covered.
The authority gives you the residence permit for up to nine months.
What you are allowed to do with this residence permit
With the residence permit from paragraph 1 or paragraph 2, you may work. You may work up to 20 hours per week. In addition, you may do a trial work placement. This trial work placement may last up to two weeks in total.
While you have this residence permit, the authority should, as a rule, not give you a residence permit for a different purpose of stay. This is a "shall" provision (Soll-Vorschrift): as a rule, you do not get a different residence title — only in special exceptional cases is it different. These exceptions only exist if another section of the Residence Act expressly allows it (§ 16a, § 16b or § 19c paragraph 2 of the Residence Act) or if you have a statutory legal entitlement to it.
(1) Einem Ausländer kann zum Zweck der Suche nach einem Ausbildungsplatz zur Durchführung einer qualifizierten Berufsausbildung eine Aufenthaltserlaubnis erteilt werden, wenn
- 1.er das 35. Lebensjahr noch nicht vollendet hat,
- 2.der Lebensunterhalt gesichert ist,
- 3.er über einen Abschluss einer deutschen Auslandsschule oder über einen Schulabschluss verfügt, der zum Hochschulzugang im Bundesgebiet oder in dem Staat berechtigt, in dem der Schulabschluss erworben wurde, und
- 4.er über ausreichende deutsche Sprachkenntnisse verfügt. Die Aufenthaltserlaubnis wird für bis zu neun Monate erteilt. Sie kann erneut nur erteilt werden, wenn sich der Ausländer nach seiner Ausreise mindestens so lange im Ausland aufgehalten hat, wie er sich zuvor auf der Grundlage einer Aufenthaltserlaubnis nach Satz 1 im Bundesgebiet aufgehalten hat.
(2) Einem Ausländer kann zum Zweck der Studienbewerbung eine Aufenthaltserlaubnis erteilt werden, wenn
- 1.er über die schulischen und sprachlichen Voraussetzungen zur Aufnahme eines Studiums verfügt oder diese innerhalb der Aufenthaltsdauer nach Satz 2 erworben werden sollen und
- 2.der Lebensunterhalt gesichert ist. Die Aufenthaltserlaubnis wird für bis zu neun Monate erteilt.
(3) Die Aufenthaltserlaubnis nach den Absätzen 1 und 2 berechtigt nur zur Ausübung einer Beschäftigung von bis zu 20 Stunden je Woche und zur Ausübung von Probebeschäftigungen von bis zu insgesamt zwei Wochen. Während des Aufenthalts nach den Absätzen 1 und 2 soll in der Regel eine Aufenthaltserlaubnis zu einem anderen Aufenthaltszweck nur nach den §§ 16a, 16b oder 19c Absatz 2 oder in Fällen eines gesetzlichen Anspruchs erteilt werden.
