§ 20a AufenthG: Opportunity Card; Authorisation to Issue Regulations

What is the Chancenkarte?
The Chancenkarte (opportunity card) is a residence permit. With the Chancenkarte, you are allowed to search for employment in Germany. Or you are allowed to use it to search for a measure for the recognition of foreign professional qualifications.
What are you allowed to do with the Chancenkarte?
The Chancenkarte allows you to do only these two things:
- You are allowed to work. On average, you may work no more than 20 hours per week.
- You are allowed to do a trial employment. Each trial employment may last no more than two weeks. One of these three conditions must apply:
- The trial employment must be qualified, or
- it must be aimed at a vocational training, or
- it must be suitable to be taken up as part of a measure for the recognition of foreign professional qualifications under section 16d.
Any other work is not allowed with the Chancenkarte.
Who can get a Chancenkarte?
You may get a Chancenkarte if one of these two conditions applies. The authority decides on your application — it is not an automatic legal entitlement.
- You are a skilled worker, or
- you have reached enough points, according to the points table in the annex to this law, for the criteria under section 20b paragraph 1 (Chancenkarte under the points system).
What further requirement applies to everyone?
You only get the Chancenkarte if your livelihood is secure.
Are you already staying in Germany? Then you only get the Chancenkarte if you already hold a residence title under section 3 or section 4 of this law.
Additional requirements for the Chancenkarte under the points system
Have you applied for the Chancenkarte through the points system? Then you additionally need the following.
A professional or academic qualification. One of these three options must apply:
- You have a foreign professional qualification. This must be officially recognized by the state in which you obtained it. And the training for it must have lasted at least two years.
- You have a foreign university degree. This must be officially recognized in the state in which you obtained it.
- You have a professional qualification obtained abroad. The training for it must, in content, duration, and manner of delivery, meet the requirements that the Vocational Training Act (Berufsbildungsgesetz) sets for vocational training. The training must be suitable to provide the professional competence needed for a training occupation under the Vocational Training Act or the Trade and Crafts Code (Handwerksordnung). And the qualification must have been issued by a German Chamber of Commerce Abroad.
Language skills. One of these two options must apply:
- You provide evidence of at least basic German language skills, or
- you provide evidence of English language skills at least at level B2 of the Common European Framework of Reference for Languages.
Important about the evidence:
- Do you have a foreign professional qualification (first option) or a foreign university degree (second option)? Then you must have the existence of this requirement confirmed by a competent domestic body. You must arrange this yourself.
- Do you have a professional qualification obtained abroad (third option)? Then it is confirmed to the body that issued your qualification that the requirements for your training abroad are met. This is done on application and at the cost of that body.
How long is the Chancenkarte valid?
You first get the Chancenkarte for no more than one year. This is called the search Chancenkarte (Such-Chancenkarte).
Extension as a follow-on Chancenkarte
You may have the Chancenkarte extended by up to two years. This is called the follow-on Chancenkarte (Folge-Chancenkarte). The authority decides on the extension.
To do this, you must submit an application during your stay with the search Chancenkarte. In addition, both of these conditions must be met:
- You have an employment contract or a binding job offer for domestic qualified employment.
- The Federal Employment Agency (Bundesagentur für Arbeit) has given its consent.
You only get a follow-on Chancenkarte if you do not meet the requirements for another residence permit under section 4 of this law.
Until the authority decides on your extension, section 81 paragraph 4 of this law applies to you — with one restriction: during this time, you may only carry out the new employment for which you applied for the follow-on Chancenkarte.
For the follow-on Chancenkarte, the restrictions from paragraph 2 (the 20-hour limit and the rules on trial employment) no longer apply.
A further extension beyond these two years is not possible.
New search Chancenkarte
Do you want to get a new search Chancenkarte after your last search Chancenkarte has ended? This is only possible if, since then, you have stayed abroad or lawfully in Germany for at least as long as you previously stayed in Germany on the basis of the search Chancenkarte.
Special rule regarding section 9
Section 9 of this law does not apply to your search Chancenkarte.
Limiting the number of Chancenkarten
The Federal Government may, by statutory ordinance, limit the number of Chancenkarten issued to foreign nationals who are not yet staying in Germany. The limit may apply for one year or for a shorter period. For this statutory ordinance, the Federal Government does not need the consent of the Bundesrat.
When setting a limit, labor-market and integration-policy considerations, as well as the capacities of the authorities involved, should normally be taken into account. In exceptional cases, this may be different.
(1) Eine Chancenkarte ist eine Aufenthaltserlaubnis zur Suche nach einer Erwerbstätigkeit oder nach Maßnahmen zur Anerkennung ausländischer Berufsqualifikationen.
(2) Die Chancenkarte berechtigt nur dazu,
- 1.eine Beschäftigung von durchschnittlich insgesamt höchstens 20 Stunden je Woche auszuüben und
- 2.eine Probebeschäftigung für jeweils höchstens zwei Wochen auszuüben, die jeweils
- a)qualifiziert sein muss,
- b)auf eine Ausbildung abzielen muss oder
- c)geeignet sein muss, im Rahmen einer Maßnahme zur Anerkennung ausländischer Berufsqualifikationen nach § 16d aufgenommen zu werden.
(3) Die Chancenkarte kann einem Ausländer erteilt werden, wenn
- 1.er eine Fachkraft ist oder
- 2.er nach Maßgabe der Tabelle in der Anlage zu diesem Gesetz eine ausreichende Punktzahl für die Erfüllung von Merkmalen nach § 20b Absatz 1 erhalten hat.
(4) Die Chancenkarte darf jedoch nur erteilt werden, wenn der Lebensunterhalt gesichert ist. Einem Ausländer, der sich bereits im Bundesgebiet aufhält, darf die Chancenkarte nur erteilt werden, wenn er im Besitz eines Aufenthaltstitels nach Abschnitt 3 oder Abschnitt 4 ist. Die Chancenkarte nach Absatz 3 Nummer 2 kann nur erteilt werden, wenn er
- 1.entweder
- a)eine ausländische Berufsqualifikation hat,
aa) die von dem Staat, in dem sie erworben worden ist, staatlich anerkannt ist und bb) deren Erlangung eine Ausbildungsdauer von mindestens zwei Jahren vorausgesetzt hat, oder b) einen ausländischen Hochschulabschluss hat, der in dem Staat, in dem er erworben worden ist, staatlich anerkannt ist, oder c) einen im Ausland erworbenen Berufsabschluss hat, der durch eine Ausbildung erworben wurde, die nach Inhalt, Dauer und der Art ihrer Durchführung die Anforderungen des Berufsbildungsgesetzes an eine Berufsausbildung einhält und geeignet ist, die notwendige berufliche Handlungsfähigkeit für einen Ausbildungsberuf nach dem Berufsbildungsgesetz oder der Handwerksordnung zu vermitteln und der von einer deutschen Auslandshandelskammer erteilt worden ist, und
- 2.der Ausländer
- a)mindestens einfache deutsche Sprachkenntnisse nachweist oder
- b)englische Sprachkenntnisse mindestens auf dem Niveau B2 des Gemeinsamen Europäischen Referenzrahmens für Sprachen nachweist. Der Ausländer ist verpflichtet, sich das Vorliegen der Voraussetzungen nach Satz 3 Nummer 1 Buchstabe a oder b von einer fachkundigen inländischen Stelle bestätigen zu lassen. Das Vorliegen der nach Satz 3 Nummer 1 Buchstabe c an die Ausbildung im Ausland gestellten Anforderungen ist gegenüber der abschlusserteilenden Stelle auf deren Antrag und Kosten zu bestätigen.
(5) Die Chancenkarte wird zunächst für einen Zeitraum von bis zu einem Jahr erteilt (Such-Chancenkarte). Die Chancenkarte kann auf Grund eines während eines Aufenthaltes nach Satz 1 gestellten Antrags um bis zu zwei Jahre als solche verlängert werden, wenn der Ausländer einen Arbeitsvertrag oder ein verbindliches Arbeitsplatzangebot für eine inländische qualifizierte Beschäftigung hat und die Bundesagentur für Arbeit zugestimmt hat (Folge-Chancenkarte). Eine Folge-Chancenkarte wird nur erteilt, wenn der Ausländer die Voraussetzungen für die Erteilung einer anderen Aufenthaltserlaubnis nach Abschnitt 4 nicht erfüllt. Für eine Verlängerung als Folge-Chancenkarte und die zukünftige Beschäftigung findet bis zur Entscheidung über die Verlängerung § 81 Absatz 4 mit der Maßgabe Anwendung, dass nur die Ausübung der zukünftigen Beschäftigung nach Satz 2 erlaubt ist. Absatz 2 findet auf die Folge-Chancenkarte keine Anwendung. Eine über Satz 2 hinausgehende Verlängerung als Chancenkarte ist ausgeschlossen. Eine Such-Chancenkarte kann erneut nur erteilt werden, wenn sich der Ausländer nach dem Ende der Geltungsdauer der letzten Such-Chancenkarte mindestens so lange im Ausland oder erlaubt im Bundesgebiet aufgehalten hat, wie er sich davor auf Grundlage einer Such-Chancenkarte im Bundesgebiet aufgehalten hat.
(6) § 9 findet in den Fällen von Absatz 5 Satz 1 keine Anwendung.
(7) Zur Steuerung der Erwerbsmigration wird die Bundesregierung ermächtigt, durch Rechtsverordnung, die nicht der Zustimmung des Bundesrates bedarf, die Zahl der Chancenkarten, die Ausländern erteilt werden, die sich noch nicht im Bundesgebiet aufhalten, jährlich oder für einen kürzeren Zeitraum zu begrenzen. Bei einer Begrenzung sollen arbeitsmarkt- und integrationspolitische Erwägungen und die Kapazitäten der beteiligten Behörden zugrunde gelegt werden.
