§ 81 AufenthG: Application for a Residence Title

You must submit an application
You only get a residence title if you apply for it. This applies unless a law states otherwise.
When must you submit the application?
Some residence titles may only be applied for after entry. This is regulated by a statutory ordinance relating to Section 99 Paragraph 1 Number 2. Does this apply to you? Then you must submit the application without undue delay after entry. Or you must meet the deadline stated in this statutory ordinance.
A special case concerns children born in Germany. Does the child not automatically receive a residence title from the authority? Then you must submit an application within six months of the birth.
What applies while your application is still being processed?
Are you staying lawfully in Germany, but without a residence title? And are you now applying for a residence title? Then your stay is legally deemed permitted until the Ausländerbehörde (foreigners authority) decides. This means: The law treats your stay as if it were permitted. This applies until the Ausländerbehörde has decided.
Did you submit this application too late? Then your deportation is legally deemed suspended from the moment you submit the application. This means: You must not be deported during this time. This applies until the Ausländerbehörde decides.
Extension or a new residence title
Do you apply for an extension before your residence title expires? Or do you apply for a different residence title before it expires? Then your previous residence title continues to apply. This means: The law treats it as if it were still valid. This applies from its actual expiry date until the Ausländerbehörde decides.
This rule does not apply to a visa under Section 6 Paragraph 1.
Did you submit the application for grant or extension too late? Then the Ausländerbehörde may still order that your previous residence title continues to apply. The authority only does this to avoid undue hardship for you. The authority decides this on a case-by-case basis. You have no automatic legal entitlement to this.
The Fiktionsbescheinigung (fiction certificate)
The authority must issue you a certificate about the effect of your application. This certificate is called a Fiktionsbescheinigung. This is mandatory for the authority.
For the cases above, an additional rule on work permission applies. Does your future residence title state employment for a stay under Chapter 2 Section 3 or Section 4? Then this employment is already deemed permitted. This applies from the time the issuance of your document was initiated. This applies until the document under Section 78 Paragraph 1 Sentence 1 is issued. The authority must include this work permission in your Fiktionsbescheinigung.
Family reunification with an ICT Card, a Mobile ICT Card, or an EU Blue Card
Are you applying for a residence permit for family reunification with a holder of an ICT Card? Or with a holder of a Mobile ICT Card or an EU Blue Card? Are you submitting this application at the same time as the application for the ICT Card, the Mobile ICT Card, or the EU Blue Card? Then the authority decides on both applications at the same time.
Normally this also applies to family reunification with a holder of a residence permit under Section 18a or Section 18b. The requirement is that both applications are submitted at the same time. In justified exceptional cases, it may be different.
There is a special case with three conditions. Condition 1: The holder of the EU Blue Card immediately before held an EU Blue Card from another Member State of the European Union. Condition 2: The family unit already existed in this other Member State of the European Union. Condition 3: The application is submitted at the same time, but the family members enter Germany only after the EU Blue Card has been granted. Are all three conditions met? Then the authority must grant the residence permit for family reunification no later than 30 days after the complete application is submitted. This is mandatory. In justified exceptional cases, the authority may extend this deadline by 30 days.
EU Blue Card from another EU country
Do you already hold an EU Blue Card from another Member State of the European Union? And are you now applying for an EU Blue Card in Germany? Then the authority must inform you of the decision no later than 30 days after the complete application is submitted. The authority notifies you and the other Member State of the European Union of this. In justified exceptional cases, the authority may extend this deadline by 30 days. If the authority extends the deadline, it must inform you of this no later than 30 days after the complete application is submitted. No later than 30 days after the complete application is submitted, you may take up employment as a holder of the EU Blue Card. This only applies if a required professional practice permit is in place.
Identity verification as a requirement
Must your identity be established through erkennungsdienstliche Behandlung (identification measures, e.g. fingerprinting)? This is regulated by Section 49 of this Act or Section 16 of the Asylum Act. Does this apply to you? Then the authority may only issue a Fiktionsbescheinigung if two things are fulfilled. First: The identification measures have been carried out. Second: The data obtained in doing so has been stored in the Central Register of Foreign Nationals. The same applies to the grant of a residence title.
(1) Ein Aufenthaltstitel wird einem Ausländer nur auf seinen Antrag erteilt, soweit nichts anderes bestimmt ist.
(2) Ein Aufenthaltstitel, der nach Maßgabe der Rechtsverordnung nach § 99 Abs. 1 Nr. 2 nach der Einreise eingeholt werden kann, ist unverzüglich nach der Einreise oder innerhalb der in der Rechtsverordnung bestimmten Frist zu beantragen. Für ein im Bundesgebiet geborenes Kind, dem nicht von Amts wegen ein Aufenthaltstitel zu erteilen ist, ist der Antrag innerhalb von sechs Monaten nach der Geburt zu stellen.
(3) Beantragt ein Ausländer, der sich rechtmäßig im Bundesgebiet aufhält, ohne einen Aufenthaltstitel zu besitzen, die Erteilung eines Aufenthaltstitels, gilt sein Aufenthalt bis zur Entscheidung der Ausländerbehörde als erlaubt. Wird der Antrag verspätet gestellt, gilt ab dem Zeitpunkt der Antragstellung bis zur Entscheidung der Ausländerbehörde die Abschiebung als ausgesetzt.
(4) Beantragt ein Ausländer vor Ablauf seines Aufenthaltstitels dessen Verlängerung oder die Erteilung eines anderen Aufenthaltstitels, gilt der bisherige Aufenthaltstitel vom Zeitpunkt seines Ablaufs bis zur Entscheidung der Ausländerbehörde als fortbestehend. Dies gilt nicht für ein Visum nach § 6 Absatz 1. Wurde der Antrag auf Erteilung oder Verlängerung eines Aufenthaltstitels verspätet gestellt, kann die Ausländerbehörde zur Vermeidung einer unbilligen Härte die Fortgeltungswirkung anordnen.
(5) Dem Ausländer ist eine Bescheinigung über die Wirkung seiner Antragstellung (Fiktionsbescheinigung) auszustellen.
(5a) In den Fällen der Absätze 3 und 4 gilt die in dem künftigen Aufenthaltstitel für einen Aufenthalt nach Kapitel 2 Abschnitt 3 und 4 beschriebene Erwerbstätigkeit ab Veranlassung der Ausstellung bis zur Ausgabe des Dokuments nach § 78 Absatz 1 Satz 1 als erlaubt. Die Erlaubnis zur Erwerbstätigkeit nach Satz 1 ist in die Bescheinigung nach Absatz 5 aufzunehmen.
(6) Wenn der Antrag auf Erteilung einer Aufenthaltserlaubnis zum Familiennachzug zu einem Inhaber einer ICT-Karte, einer Mobiler-ICT-Karte oder einer Blauen Karte EU gleichzeitig mit dem Antrag auf Erteilung einer ICT-Karte, einer Mobiler-ICT-Karte oder einer Blauen Karte EU gestellt wird, so wird über den Antrag auf Erteilung einer Aufenthaltserlaubnis zum Zweck des Familiennachzugs gleichzeitig mit diesem Antrag entschieden. Dies gilt in der Regel auch, wenn der Antrag auf Erteilung einer Aufenthaltserlaubnis zum Zweck des Familiennachzugs zu einem Inhaber einer Aufenthaltserlaubnis nach § 18a oder § 18b gleichzeitig mit dem Antrag auf Erteilung einer Aufenthaltserlaubnis nach § 18a oder § 18b gestellt wird. War der Inhaber der Blauen Karte EU unmittelbar vor der Erteilung der Blauen Karte EU im Besitz einer Blauen Karte EU, die ein anderer Mitgliedstaat der Europäischen Union ausgestellt hat, bestand die familiäre Lebensgemeinschaft bereits in dem anderen Mitgliedstaat der Europäischen Union und wird der Antrag zwar gleichzeitig gestellt, aber die Familienangehörigen reisen erst in das Bundesgebiet ein, nachdem die Blaue Karte EU erteilt wurde, ist die Aufenthaltserlaubnis zum Zweck des Familiennachzugs spätestens 30 Tage nach der Einreichung des vollständigen Antrags zu erteilen. In begründeten Ausnahmefällen kann die Frist um 30 Tage verlängert werden.
(6a) Ist der Ausländer im Besitz einer Blauen Karte EU, die ein anderer Mitgliedstaat der Europäischen Union ausgestellt hat, wird die Entscheidung über den Antrag auf Erteilung einer Blauen Karte EU dem Antragsteller und dem anderen Mitgliedstaat der Europäischen Union spätestens 30 Tage nach dem Tag der Einreichung des vollständigen Antrags mitgeteilt. In begründeten Ausnahmefällen kann die Frist um 30 Tage verlängert werden. Der Antragsteller ist spätestens 30 Tage nach dem Tag der Einreichung des vollständigen Antrags von der Verlängerung in Kenntnis zu setzen. Spätestens 30 Tage nach dem Tag der Einreichung des vollständigen Antrags darf der Inhaber der Blauen Karte EU die Beschäftigung ausüben, soweit eine erforderliche Berufsausübungserlaubnis vorliegt.
(7) Ist die Identität durch erkennungsdienstliche Behandlung gemäß § 49 dieses Gesetzes oder § 16 des Asylgesetzes zu sichern, so darf eine Fiktionsbescheinigung nach Absatz 5 nur ausgestellt oder ein Aufenthaltstitel nur erteilt werden, wenn die erkennungsdienstliche Behandlung durchgeführt worden ist und eine Speicherung der hierdurch gewonnenen Daten im Ausländerzentralregister erfolgt ist.
